413 AN ACT
514 relating to the disclosure of certain information regarding course
615 materials by public institutions of higher education.
716 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
817 SECTION 1. Subchapter I, Chapter 51, Education Code, is
918 amended by adding Section 51.4521 to read as follows:
1019 Sec. 51.4521. PUBLIC INSTITUTIONS: DISSEMINATION OF COURSE
1120 SCHEDULE AND LIST OF REQUIRED AND RECOMMENDED COURSE MATERIALS.
1221 (a) In this section:
1322 (1) "Course material" means a textbook, supplemental
1423 material, or open educational resource.
1524 (2) "Institution of higher education,"
1625 notwithstanding Section 51.451, has the meaning assigned by Section
1726 61.003.
1827 (b) Not later than the 30th day before the first day that
1928 classes are conducted for each semester or academic term, each
2029 institution of higher education shall:
2130 (1) compile a course schedule indicating each course
2231 offered by the institution for the semester or term to
2332 postsecondary students;
2433 (2) with respect to each course, include with the
2534 schedule, or provide in a prominent location in the schedule a link
2635 to an Internet website, such as the Internet website of a college
2736 bookstore, that contains, a list of the required and recommended
2837 course materials that specifies, to the extent practicable, the
2938 following information for each course material, as applicable:
3039 (A) the retail price;
3140 (B) the author;
3241 (C) the publisher or provider;
3342 (D) the most recent copyright date;
3443 (E) the International Standard Book Number
3544 assigned, if any;
3645 (F) whether the course material is an open
3746 educational resource; and
3847 (G) any associated fee or charge, such as a
3948 technology cost, library use cost, or printing or publication fee;
4049 (3) in a prominent location in the schedule, state or
4150 provide an Internet website link to:
4251 (A) the full amount of any fee or charge for
4352 course materials assessed by the institution or another entity
4453 under an agreement with the institution, including a statement
4554 regarding whether the fee or charge is included in the cost of
4655 tuition;
4756 (B) if a course material is in a primarily
4857 electronic format, the terms under which the publisher or provider
4958 collects and uses student data obtained through a student's use of
5059 the course material; and
5160 (C) any provision that allows the student to opt
5261 out of a fee or charge described by Paragraph (A); and
5362 (4) make information regarding the cost of course
5463 materials on the course materials list under Subdivision (2)
5564 available to college bookstores and other providers of course
5665 materials that serve the students of the institution.
5766 (c) As soon as practicable after the information becomes
5867 available, each institution of higher education shall make
5968 available specific information regarding any revisions to the
6069 institution's course schedule and course materials list.
6170 (d) An institution of higher education shall itemize a fee
6271 or charge for course materials assessed by the institution or
6372 another entity under an agreement with the institution separately
6473 from any other fees or charges assessed for a course or course
6574 section in the institution's billing to the student. This
6675 subsection may not be construed to prohibit an institution of
6776 higher education from including the cost of course materials as
6877 part of the institution's tuition.
6978 (e) Any agreement between an institution of higher
7079 education and an entity under which the institution agrees to
7180 assess or allows the entity to assess a fee or charge for course
7281 materials to students enrolled at the institution is public
7382 information under Chapter 552, Government Code.
7483 (f) To allow for timely placement of course material orders
7584 by students, each institution of higher education shall establish a
7685 deadline by which faculty members must submit information to be
7786 included in the course schedule and course materials list required
7887 by Subsection (b).
7988 (g) If an institution of higher education or a college
8089 bookstore publishes a course materials list with a course schedule
8190 on an Internet website that provides a search function, the
8291 institution or bookstore must:
8392 (1) ensure that the search function permits a search
8493 based on whether a course or section of a course requires or
8594 recommends only open educational resources; or
8695 (2) provide a searchable list of courses and sections
8796 of courses that require or recommend only open educational
8897 resources.
8998 (h) If an institution of higher education designates in the
9099 institution's course schedule certain courses or sections of
91100 courses as having low course material costs or a similar
92101 designation, the institution shall, in a prominent location in the
93102 schedule, state or provide an Internet website link to the criteria
94103 for that designation.
95104 (i) This section may not be construed to affect any
96105 authority granted to a faculty member by an institution of higher
97106 education to select course materials for courses taught by the
98107 faculty member.
99108 SECTION 2. Section 51.451, Education Code, is amended by
100109 amending Subdivision (4) and adding Subdivision (4-b) to read as
101110 follows:
102111 (4) "Institution of higher education" means:
103112 (A) an institution of higher education as defined
104113 by Section 61.003; or
105114 (B) a private or independent institution of
106115 higher education [as defined by Section 61.003].
107116 (4-b) "Private or independent institution of higher
108117 education" has the meaning assigned by Section 61.003.
109118 SECTION 3. Section 51.452, Education Code, is amended to
110119 read as follows:
111120 Sec. 51.452. PRIVATE INSTITUTIONS: DISSEMINATION OF COURSE
112121 SCHEDULE AND LIST OF REQUIRED AND RECOMMENDED TEXTBOOKS. (a) Each
113122 private or independent institution of higher education shall:
114123 (1) for each semester or academic term, compile a
115124 course schedule indicating each course offered by the institution
116125 for the semester or term to postsecondary students;
117126 (2) with respect to each course, include with the
118127 schedule a list of the required and recommended textbooks that
119128 specifies, to the extent practicable, the following information for
120129 each textbook:
121130 (A) the retail price;
122131 (B) the author;
123132 (C) the publisher;
124133 (D) the most recent copyright date;
125134 (E) the International Standard Book Number
126135 assigned, if any; and
127136 (F) whether the textbook is an open educational
128137 resource;
129138 (3) except as provided by Subsection (b), at the time
130139 required by Subsection (c)(2):
131140 (A) publish the textbook list with the course
132141 schedule on the institution's Internet website and with any course
133142 schedule the institution provides in hard copy format to the
134143 students of the institution; and
135144 (B) make that information available to college
136145 bookstores and other bookstores that generally serve the students
137146 of the institution; and
138147 (4) except as provided by Subsection (b), as soon as
139148 practicable after the information becomes available disseminate as
140149 required by Subdivision (3) specific information regarding any
141150 revisions to the institution's course schedule and textbook list.
142151 (b) A private or independent [An] institution of higher
143152 education is not required to publish a textbook list as described by
144153 Subsection (a)(3)(A) or any revisions to that textbook list as
145154 described by Subsection (a)(4) if a college bookstore publishes
146155 that list and any revisions to that list on the bookstore's Internet
147156 website on behalf of the institution at the appropriate times
148157 required by this section.
149158 (c) To allow for timely placement of textbook orders by
150159 students, each private or independent institution of higher
151160 education shall:
152161 (1) establish a deadline by which faculty members must
153162 submit information to be included in the course schedule and
154163 textbook list required by Subsection (a); and
155164 (2) disseminate the institution's course schedule and
156165 textbook list as required by Subsection (a)(3) as soon as
157166 practicable after the institution has compiled the schedule and
158167 list but not later than the 30th day before the first day that
159168 classes are conducted for the semester or other academic term for
160169 which the schedule and list are compiled.
161170 (d) If a private or independent [an] institution of higher
162171 education or a college bookstore publishes a textbook list with a
163172 course schedule on an Internet website that provides a search
164173 function, the institution or bookstore must:
165174 (1) ensure that the search function permits a search
166175 based on whether a course or section of a course requires or
167176 recommends only open educational resources; or
168177 (2) provide a searchable list of courses and sections
169178 of courses that require or recommend only open educational
170179 resources.
171180 SECTION 4. Section 51.452, Education Code, as amended by
172181 this Act, and Section 51.4521, Education Code, as added by this Act,
173182 apply beginning with the 2022 fall semester.
174183 SECTION 5. This Act takes effect September 1, 2021.
