125 A BILL TO BE ENTITLED
136 AN ACT
147 relating to digital citizenship instruction in public schools.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Section 28.002(z), Education Code, is amended to
1710 read as follows:
1811 (z) The State Board of Education by rule shall require each
1912 school district to incorporate instruction in digital citizenship
2013 into the district's curriculum, including information regarding
2114 the potential criminal consequences of cyberbullying, and require
2215 students enrolled in grade level six to complete instruction in
2316 digital citizenship as part of the district's social studies
2417 curriculum. In this subsection:
2518 (1) "Cyberbullying" has the meaning assigned by
2619 Section 37.0832.
2720 (2) "Digital citizenship" means the standards of
2821 appropriate, responsible, and healthy online behavior, including:
2922 (A) the ability to access, analyze, evaluate,
3023 create, and act on all forms of digital communication;
3124 (B) digital ethics, etiquette, respectful
3225 discourse with people who have differing opinions, safety,
3326 security, digital footprint, and the identification of rhetoric
34- that incites violence;
27+ that incites violence based on a person's race, religion, or
28+ political affiliation;
3529 (C) cyberbullying prevention and response; and
3630 (D) the importance of the right to freedom of
3731 speech contained in the Bill of Rights of the Constitution of the
3832 United States, including:
3933 (i) the central role that the right to
4034 freedom of speech has in the history of the United States; and
4135 (ii) the applicability of protections for
4236 freedom of speech for online interaction.
4337 SECTION 2. This Act applies beginning with the 2021-2022
4438 school year.
4539 SECTION 3. This Act takes effect immediately if it receives
4640 a vote of two-thirds of all the members elected to each house, as
4741 provided by Section 39, Article III, Texas Constitution. If this
4842 Act does not receive the vote necessary for immediate effect, this
4943 Act takes effect September 1, 2021.
