95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to the county in which an application for court-ordered
128 mental health services must be filed.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Section 574.001(b), Health and Safety Code, is
1511 amended to read as follows:
1612 (b) Except as provided by Subsection (f), the application
1713 must be filed with the county clerk in the county in which the
1814 proposed patient:
1915 (1) resides;
2016 (2) is found; [or]
2117 (3) is being assessed in an emergency room or
2218 hospital; or
2319 (4) is receiving mental health services by court order
2420 or under Subchapter A, Chapter 573.
2521 SECTION 2. This Act takes effect September 1, 2021.
