| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Subchapter A, Chapter 65, Election Code, is |
|---|
| 16 | 9 | | amended by adding Section 65.016 to read as follows: |
|---|
| 17 | 10 | | Sec. 65.016. VIDEO RECORDING OF COUNTING LOCATIONS. (a) |
|---|
| 18 | 11 | | This section applies to: |
|---|
| 19 | 12 | | (1) a primary election; |
|---|
| 20 | 13 | | (2) the general election for state and county |
|---|
| 21 | 14 | | officers; and |
|---|
| 22 | 15 | | (3) an election in which the county clerk serves as the |
|---|
| 23 | 16 | | early voting clerk. |
|---|
| 24 | 17 | | (b) The general custodian of election records shall |
|---|
| 25 | 18 | | implement a video surveillance system that retains a record of all |
|---|
| 26 | 19 | | areas containing voted ballots from the time the ballots are |
|---|
| 27 | 20 | | delivered to the general custodian of election records until the |
|---|
| 28 | 21 | | canvass of precinct election returns. The video recording shall be |
|---|
| 29 | 22 | | retained in the same manner as a precinct election record under |
|---|
| 30 | 23 | | Section 66.058. |

| 31 | | - | (c) Subject to Subsection (e), the general custodian of |

| 46 | 36 | | appropriate to most effectively facilitate the purpose for which |
|---|
| 47 | 37 | | the funds are made available. |

| 48 | 38 | | (c) The secretary of state shall prescribe any necessary |
|---|
| 49 | 39 | | rules and take any appropriate action to implement this section. |

| 50 | 40 | | SECTION 3. Subchapter A, Chapter 31, Election Code, is |
|---|
| 51 | 41 | | amended by adding Section 31.0112 to read as follows: |

| 52 | 42 | | Sec. 31.0112. VIDEO RECORDING OF COUNTING LOCATIONS FUND. |
|---|
| 53 | 43 | | (a) The video recording of counting locations fund is an account in |
|---|
| 54 | 44 | | the general fund. |
|---|
| 55 | 45 | | (b) The secretary of state shall establish a grant program |
|---|
| 56 | 46 | | to assist counties with the implementation of this section. |
|---|
| 57 | 47 | | (c) If a federal program makes funding available to this |
|---|
| 58 | 48 | | state for the purpose of video recording of ballot counting |
|---|
| 59 | 49 | | locations, state funds appropriated under this section may be used |
|---|
| 60 | 50 | | to meet federal matching requirements under the federal program. |
|---|
| 61 | 51 | | (d) The fund is exempt from the application of Section |
|---|
| 62 | 52 | | 403.095, Government Code. |
|---|
| 63 | 53 | | SECTION 4. The governing body of a political subdivision is |
|---|
| 64 | 54 | | required to implement a provision of this Act only if the |
|---|
| 65 | 55 | | legislature appropriates money specifically for that purpose. If |
|---|
| 66 | 56 | | the legislature does not appropriate money specifically for that |
|---|
| 67 | 57 | | purpose, the governing body may, but is not required to, implement a |
|---|
| 68 | 58 | | provision of this Act using other appropriations available for that |
|---|
| 69 | 59 | | purpose. |
|---|
| 70 | 60 | | SECTION 5. This Act takes effect September 1, 2021. |
