95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to the use of dyed diesel fuel to operate a motor vehicle
128 during and for a limited period following certain disasters.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Section 162.235, Tax Code, is amended by adding
1511 Subsection (c) to read as follows:
1612 (c) Notwithstanding Subsection (a), a person who purchases
1713 dyed motor fuel and furnishes to the licensed supplier or
1814 distributor under Section 162.206(a) a signed statement that
1915 includes an end user number issued by the comptroller may operate a
2016 motor vehicle on a public highway in this state with that dyed motor
2117 fuel in the fuel supply tank of the motor vehicle during a period
2218 beginning on the date a state of disaster is declared under Section
2319 418.014, Government Code, due to a fire, flood, earthquake,
2420 tornado, hurricane, storm, or energy emergency and ending on the
2521 30th day after the declaration expires or otherwise terminates, if
2622 the motor vehicle is operated:
2723 (1) in the area designated a disaster area by the
2824 disaster declaration; or
2925 (2) in an area other than the area described by
3026 Subdivision (1) if the dyed motor fuel was placed in the fuel supply
3127 tank of the motor vehicle in the area described by that subdivision.
3228 SECTION 2. The change in law made by this Act applies only
3329 to conduct that occurs on or after the effective date of this Act.
3430 Conduct that occurred before the effective date of this Act is
3531 governed by the law in effect on the date the conduct occurred, and
3632 the former law is continued in effect for that purpose. For
3733 purposes of this section, conduct occurred before the effective
3834 date of this Act if any element of the conduct occurred before that
3935 date.
4036 SECTION 3. This Act takes effect September 1, 2021.
