| 11 | 7 | | relating to the use of dyed diesel fuel to operate a motor vehicle |

| 12 | 8 | | during and for a limited period following certain disasters. |

| 13 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 10 | | SECTION 1. Section 162.235, Tax Code, is amended by adding |
|---|
| 15 | 11 | | Subsection (c) to read as follows: |
|---|
| 16 | 12 | | (c) Notwithstanding Subsection (a), a person who purchases |
|---|
| 17 | 13 | | dyed motor fuel and furnishes to the licensed supplier or |
|---|
| 18 | 14 | | distributor under Section 162.206(a) a signed statement that |
|---|
| 19 | 15 | | includes an end user number issued by the comptroller may operate a |
|---|
| 20 | 16 | | motor vehicle on a public highway in this state with that dyed motor |
|---|
| 21 | 17 | | fuel in the fuel supply tank of the motor vehicle during a period |
|---|
| 22 | 18 | | beginning on the date a state of disaster is declared under Section |
|---|
| 23 | 19 | | 418.014, Government Code, due to a fire, flood, earthquake, |
|---|
| 24 | 20 | | tornado, hurricane, storm, or energy emergency and ending on the |
|---|
| 25 | 21 | | 30th day after the declaration expires or otherwise terminates, if |
|---|
| 26 | 22 | | the motor vehicle is operated: |
|---|
| 27 | 23 | | (1) in the area designated a disaster area by the |
|---|
| 28 | 24 | | disaster declaration; or |
|---|
| 29 | 25 | | (2) in an area other than the area described by |
|---|
| 30 | 26 | | Subdivision (1) if the dyed motor fuel was placed in the fuel supply |
|---|
| 31 | 27 | | tank of the motor vehicle in the area described by that subdivision. |

| 32 | 28 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 33 | 29 | | to conduct that occurs on or after the effective date of this Act. |
|---|
| 34 | 30 | | Conduct that occurred before the effective date of this Act is |
|---|
| 35 | 31 | | governed by the law in effect on the date the conduct occurred, and |
|---|
| 36 | 32 | | the former law is continued in effect for that purpose. For |
|---|
| 37 | 33 | | purposes of this section, conduct occurred before the effective |
|---|
| 38 | 34 | | date of this Act if any element of the conduct occurred before that |
|---|
| 39 | 35 | | date. |
|---|
| 40 | 36 | | SECTION 3. This Act takes effect September 1, 2021. |
