9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the liability of a landlord for damages resulting from
612 the execution of a writ of possession in an eviction suit.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 24.0061, Property Code, is amended by
915 adding Subsection (i) to read as follows:
1016 (i) A landlord is not liable for damages to the tenant
1117 resulting from the execution of a writ of possession by an officer
1218 under this section.
1319 SECTION 2. Section 24.0061(i), Property Code, as added by
1420 this Act, applies only to the execution of a writ of possession
1521 issued in an eviction suit filed on or after the effective date of
1622 this Act. Execution of a writ of possession issued in an eviction
1723 suit filed before the effective date of this Act is governed by the
1824 law in effect immediately before the effective date of this Act, and
1925 that law is continued in effect for that purpose.
2026 SECTION 3. This Act takes effect September 1, 2021.
