48 AN ACT
59 relating to the prosecution of the offense of sexual assault.
610 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
711 SECTION 1. Section 22.011(b), Penal Code, is amended to
812 read as follows:
913 (b) A sexual assault under Subsection (a)(1) is without the
1014 consent of the other person if:
1115 (1) the actor compels the other person to submit or
1216 participate by the use of physical force, violence, or coercion;
1317 (2) the actor compels the other person to submit or
1418 participate by threatening to use force or violence against the
1519 other person or to cause harm to the other person, and the other
1620 person believes that the actor has the present ability to execute
1721 the threat;
1822 (3) the other person has not consented and the actor
1923 knows the other person is unconscious or physically unable to
2024 resist;
2125 (4) the actor knows that as a result of mental disease
2226 or defect the other person is at the time of the sexual assault
2327 incapable either of appraising the nature of the act or of resisting
2428 it;
2529 (5) the other person has not consented and the actor
2630 knows the other person is unaware that the sexual assault is
2731 occurring;
2832 (6) the actor has intentionally impaired the other
2933 person's power to appraise or control the other person's conduct by
3034 administering any substance without the other person's knowledge;
3135 (7) the actor compels the other person to submit or
3236 participate by threatening to use force or violence against any
3337 person, and the other person believes that the actor has the ability
3438 to execute the threat;
3539 (8) the actor is a public servant who coerces the other
3640 person to submit or participate;
3741 (9) the actor is a mental health services provider or a
3842 health care services provider who causes the other person, who is a
3943 patient or former patient of the actor, to submit or participate by
4044 exploiting the other person's emotional dependency on the actor;
4145 (10) the actor is a clergyman who causes the other
4246 person to submit or participate by exploiting the other person's
4347 emotional dependency on the clergyman in the clergyman's
4448 professional character as spiritual adviser;
4549 (11) the actor is an employee of a facility where the
4650 other person is a resident, unless the employee and resident are
4751 formally or informally married to each other under Chapter 2,
4852 Family Code; [or]
4953 (12) the actor is a health care services provider who,
5054 in the course of performing an assisted reproduction procedure on
5155 the other person, uses human reproductive material from a donor
5256 knowing that the other person has not expressly consented to the use
5357 of material from that donor;
54- (13) the actor is a coach or tutor who causes the other
58+ (13) the actor knows the other person is intoxicated
59+ by any substance such that the other person is incapable of
60+ appraising the nature of the act;
61+ (14) the actor knows that the other person has
62+ withdrawn consent to the act and the actor persists in the act after
63+ consent is withdrawn;
64+ (15) the actor is a coach or tutor who causes the other
5565 person to submit or participate by using the actor's power or
5666 influence to exploit the other person's dependency on the actor; or
57- (14) the actor is a caregiver hired to assist the other
67+ (16) the actor is a caregiver hired to assist the other
5868 person with activities of daily life and causes the other person to
5969 submit or participate by exploiting the other person's dependency
6070 on the actor.
6171 SECTION 2. The change in law made by this Act applies only
6272 to an offense committed on or after the effective date of this Act.
6373 An offense committed before the effective date of this Act is
6474 governed by the law in effect on the date the offense was committed,
6575 and the former law is continued in effect for that purpose. For
6676 purposes of this section, an offense was committed before the
6777 effective date of this Act if any element of the offense occurred
6878 before that date.
6979 SECTION 3. This Act takes effect September 1, 2021.
