46 AN ACT
57 relating to the lease, rental, and donation to the United States of
68 certain facilities relating to a toll bridge by certain counties
79 and municipalities.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter A, Chapter 364, Transportation Code,
1012 is amended by adding Section 364.005 to read as follows:
1113 Sec. 364.005. LEASE, RENTAL, OR DONATION OF FACILITY TO
1214 UNITED STATES. (a) A county may lease, rent, or donate to the
1315 United States property or a building, structure, or other facility
1416 acquired, constructed, improved, enlarged, or equipped in whole or
1517 in part with proceeds from the sale of bonds issued by a county
1618 under this chapter.
1719 (b) The acquisition, construction, improvement,
1820 enlargement, or equipment by a county of property or a building,
1921 structure, or other facility for lease to and the donation of
2022 property or a building, structure, or other facility by a county to
2123 the United States for use in performing a federal governmental
2224 function in the county or at or near and relating to a toll bridge of
2325 the county is a public purpose and proper county function,
2426 regardless of whether the toll bridge or the federal facility
2527 relating to the toll bridge is located inside or outside the county.
2628 SECTION 2. Section 364.043(a), Transportation Code, is
2729 amended to read as follows:
2830 (a) A county, through the commissioners court, may issue,
2931 sell, and deliver negotiable bonds to accomplish the purposes of
3032 this chapter. The county may use the bonds or the proceeds of the
3133 sale of the bonds to acquire, construct, improve, enlarge, or equip
3234 in whole or in part a toll bridge or a related building, structure,
3335 or other facility under this chapter or may exchange the bonds for
3436 property to accomplish the purposes of this chapter.
3537 SECTION 3. Section 367.012, Transportation Code, is amended
3638 to read as follows:
3739 Sec. 367.012. PUBLIC PURPOSE. The acquisition,
3840 construction, improvement, enlargement, or equipment by a
3941 municipality of property or a building, structure, or other
4042 facility for lease to and the donation of property or a building,
4143 structure, or other facility by a municipality to the United States
4244 for use in performing a federal governmental function in the
4345 municipality or at or near and relating to a toll bridge of the
4446 municipality is a public purpose and a proper municipal function,
4547 regardless of whether the toll bridge or the federal facility
4648 relating to the toll bridge is located inside or outside the
4749 municipality.
4850 SECTION 4. Section 367.013, Transportation Code, is amended
4951 to read as follows:
5052 Sec. 367.013. LEASE, [OR] RENTAL, OR DONATION OF FACILITY
5153 TO UNITED STATES. A municipality may lease, [or] rent, or donate to
5254 the United States property or a building, structure, or other
5355 facility acquired, constructed, improved, enlarged, or equipped in
5456 whole or in part with proceeds from the sale of bonds issued under
5557 this subchapter.
5658 SECTION 5. The change in law made by this Act applies only
5759 to a bond issued on or after the effective date of this Act. A bond
5860 issued before the effective date of this Act is governed by the
5961 applicable law in effect before the effective date of this Act, and
6062 the former law is continued in effect for that purpose.
6163 SECTION 6. This Act takes effect immediately if it receives
6264 a vote of two-thirds of all the members elected to each house, as
6365 provided by Section 39, Article III, Texas Constitution. If this
6466 Act does not receive the vote necessary for immediate effect, this
6567 Act takes effect September 1, 2021.
