4	6		AN ACT
5	7		relating to the lease, rental, and donation to the United States of
6	8		certain facilities relating to a toll bridge by certain counties
7	9		and municipalities.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Subchapter A, Chapter 364, Transportation Code,
10	12		is amended by adding Section 364.005 to read as follows:
11	13		Sec. 364.005. LEASE, RENTAL, OR DONATION OF FACILITY TO
12	14		UNITED STATES. (a) A county may lease, rent, or donate to the
13	15		United States property or a building, structure, or other facility
14	16		acquired, constructed, improved, enlarged, or equipped in whole or
15	17		in part with proceeds from the sale of bonds issued by a county
16	18		under this chapter.
17	19		(b) The acquisition, construction, improvement,
18	20		enlargement, or equipment by a county of property or a building,
19	21		structure, or other facility for lease to and the donation of
20	22		property or a building, structure, or other facility by a county to
21	23		the United States for use in performing a federal governmental
22	24		function in the county or at or near and relating to a toll bridge of
23	25		the county is a public purpose and proper county function,
24	26		regardless of whether the toll bridge or the federal facility
25	27		relating to the toll bridge is located inside or outside the county.
26	28		SECTION 2. Section 364.043(a), Transportation Code, is
27	29		amended to read as follows:
28	30		(a) A county, through the commissioners court, may issue,
29	31		sell, and deliver negotiable bonds to accomplish the purposes of
30	32		this chapter. The county may use the bonds or the proceeds of the
31	33		sale of the bonds to acquire, construct, improve, enlarge, or equip
32	34		in whole or in part a toll bridge or a related building, structure,
33	35		or other facility under this chapter or may exchange the bonds for
34	36		property to accomplish the purposes of this chapter.
35	37		SECTION 3. Section 367.012, Transportation Code, is amended
36	38		to read as follows:
37	39		Sec. 367.012. PUBLIC PURPOSE. The acquisition,
38	40		construction, improvement, enlargement, or equipment by a
39	41		municipality of property or a building, structure, or other
40	42		facility for lease to and the donation of property or a building,
41	43		structure, or other facility by a municipality to the United States
42	44		for use in performing a federal governmental function in the
43	45		municipality or at or near and relating to a toll bridge of the
44	46		municipality is a public purpose and a proper municipal function,
45	47		regardless of whether the toll bridge or the federal facility
46	48		relating to the toll bridge is located inside or outside the
47	49		municipality.
48	50		SECTION 4. Section 367.013, Transportation Code, is amended
49	51		to read as follows:
50	52		Sec. 367.013. LEASE, [OR] RENTAL, OR DONATION OF FACILITY
51	53		TO UNITED STATES. A municipality may lease, [or] rent, or donate to
52	54		the United States property or a building, structure, or other
53	55		facility acquired, constructed, improved, enlarged, or equipped in
54	56		whole or in part with proceeds from the sale of bonds issued under
55	57		this subchapter.
56	58		SECTION 5. The change in law made by this Act applies only
57	59		to a bond issued on or after the effective date of this Act. A bond
58	60		issued before the effective date of this Act is governed by the
59	61		applicable law in effect before the effective date of this Act, and
60	62		the former law is continued in effect for that purpose.
61	63		SECTION 6. This Act takes effect immediately if it receives
62	64		a vote of two-thirds of all the members elected to each house, as
63	65		provided by Section 39, Article III, Texas Constitution. If this
64	66		Act does not receive the vote necessary for immediate effect, this
65	67		Act takes effect September 1, 2021.
