46 AN ACT
57 relating to the payment of fees and costs associated with driver
68 education and safety courses and driver's license examinations for
79 foster children or youth, former foster children or youth, and
810 youth experiencing homelessness.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter H, Chapter 521, Transportation Code,
1113 is amended by adding Section 521.168 to read as follows:
1214 Sec. 521.168. PAYMENT OF FEES FOR CERTAIN FOSTER AND
1315 HOMELESS CHILDREN AND YOUTHS. (a) Unless prohibited under Section
1416 521.4265(c), the Texas Workforce Commission shall on request pay
1517 the fees associated with meeting a requirement imposed under this
1618 subchapter or Chapter 1001, Education Code, for a person who is:
1719 (1) eligible for a driver's license fee exemption
1820 under Section 521.1811; or
1921 (2) younger than 26 years of age and:
2022 (A) was in the managing conservatorship of the
2123 Department of Family and Protective Services on the day before the
2224 person's 18th birthday; or
2325 (B) is a homeless child or youth as defined by 42
2426 U.S.C. Section 11434a.
2527 (b) The Texas Workforce Commission by rule shall establish a
2628 process by which:
2729 (1) a person described by Subsection (a) may apply to
2830 that commission for the payment of fees under this section; and
2931 (2) that commission pays fees associated with meeting
3032 a requirement imposed under this subchapter or Chapter 1001,
3133 Education Code, to appropriate entities on behalf of the person
3234 described by Subsection (a).
3335 SECTION 2. Section 521.4265, Transportation Code, is
3436 amended by amending Subsections (b) and (c) and adding Subsection
3537 (d) to read as follows:
3638 (b) From the money in the identification fee exemption
3739 account the department shall:
3840 (1) request that the comptroller transfer to the Texas
39- Workforce Commission amounts sufficient to cover the cost of
40- implementing the program under Section 521.168, including amounts
41- sufficient for the payment by the Texas Workforce Commission of:
42- (A) fees to entities other than the department;
43- and
44- (B) the Texas Workforce Commission's
45- implementation costs; and
46- (2) for [For] each exemption granted under Section
41+ Workforce Commission amounts sufficient to provide for the payment
42+ by the Texas Workforce Commission of fees to entities other than the
43+ department under Section 521.168;
44+ (2) pay the department's costs associated with
45+ administering Subdivision (1); and
46+ (3) for [For] each exemption granted under Section
4747 521.1015 or 521.1811, [the department shall] deposit to the credit
4848 of the Texas mobility fund an amount [from the identification fee
4949 exemption account under Subsection (a)] that is equal to the amount
5050 of the waived fee that would otherwise be deposited to the mobility
5151 fund.
5252 (c) The department may not:
53- (1) request a transfer under Subsection (b)(1) if the
54- balance of the account for the fiscal year is less than three times
55- the amount expended in the previous fiscal year for the waivers
56- provided by Sections 521.1015(e) and 521.1811; or
53+ (1) request a transfer under Subsection (b)(1) or pay
54+ a cost under Subsection (b)(2) if the department determines in
55+ consultation with the Texas Workforce Commission that the balance
56+ of the account is insufficient; or
5757 (2) grant an exemption under Section 521.1015 or
5858 521.1811 if money is not available in the identification fee
59- exemption account to meet the requirements of Subsection (b)(2)
59+ exemption account to meet the requirements of Subsection (b)(3)
6060 [(b)].
6161 (d) The department, in consultation with the Texas
6262 Workforce Commission, by rule shall establish a process by which
6363 transfers are made under Subsection (b).
6464 SECTION 3. This Act takes effect September 1, 2021.
