| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Chapter 2, Code of Criminal Procedure, is |
|---|
| 9 | 11 | | amended by adding Article 2.33 to read as follows: |
|---|
| 10 | 12 | | Art. 2.33. DUTY TO REQUEST AND RENDER AID. (a) Except as |
|---|
| 11 | 13 | | provided by Subsection (b), a peace officer who encounters an |
|---|
| 12 | 14 | | injured person while discharging the officer's official duties |
|---|
| 13 | 15 | | shall immediately and as necessary: |
|---|
| 14 | 16 | | (1) request emergency medical services personnel to |
|---|
| 15 | 17 | | provide the person with emergency medical services; and |
|---|
| 16 | 18 | | (2) while waiting for emergency medical services |
|---|
| 17 | 19 | | personnel to arrive, provide first aid or treatment to the person to |
|---|
| 18 | 20 | | the extent of the officer's skill and training. |
|---|
| 19 | 21 | | (b) The peace officer is not required to request emergency |
|---|
| 20 | 22 | | medical services or provide first aid or treatment under Subsection |
|---|
| 21 | 23 | | (a) if: |
|---|
| 22 | 24 | | (1) making the request or providing the treatment |
|---|
| 23 | 25 | | would expose the officer or another person to a risk of bodily |
|---|
| 24 | 26 | | injury; or |
|---|
| 25 | 27 | | (2) the officer is injured and physically unable to |
|---|
| 26 | 28 | | make the request or provide the treatment. |
|---|
| 27 | 29 | | SECTION 2. This Act takes effect September 1, 2021. |
