6- the Jobs and Education for Texans (JET) Grant Program.
7+ relating to the participation of open-enrollment charter schools
8+ and eligible nonprofit organizations in the Jobs and Education for
9+ Texans (JET) Grant Program.
710 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
811 SECTION 1. Section 134.004, Education Code, is amended to
912 read as follows:
1013 Sec. 134.004. JOBS AND EDUCATION FOR TEXANS (JET) GRANT
1114 PROGRAM. (a) The commission shall establish and administer the
1215 Jobs and Education for Texans (JET) Grant Program to provide grants
1316 to public junior colleges, public technical institutes, public
14- state colleges, and independent school districts and
15- open-enrollment charter schools described under Section 134.007
16- that apply to the advisory board in the manner prescribed by the
17- advisory board. The commission shall award the grants on the advice
18- and recommendations of the advisory board.

2427 districts and open-enrollment charter schools described under
2528 Section 134.007 that meet the requirements of Section 134.006.
26- SECTION 2. Sections 134.006(a) and (d), Education Code, are

30+ adding Subdivision (1-a) to read as follows:
31+ (1-a) "Nonprofit organization" means an organization
32+ exempt from federal income taxation under Section 501(a), Internal
33+ Revenue Code of 1986, as an organization described by Section
34+ 501(c)(3) of that code.
35+ SECTION 3. Chapter 134, Education Code, is amended by
36+ adding Section 134.005 to read as follows:
37+ Sec. 134.005. GRANTS TO NONPROFIT ORGANIZATIONS FOR
38+ INNOVATIVE AND SUCCESSFUL PROGRAMS. (a) The commission may award
39+ a grant to a nonprofit organization eligible under Subsection (b)
40+ for the development, support, or expansion of programs to prepare
41+ low-income students for careers in high-demand occupations.
42+ (b) To be eligible to receive a grant under this section, a
43+ nonprofit organization must:
44+ (1) provide a program to offer assistance to
45+ low-income students in preparing for, applying to and enrolling in
46+ a public junior college or public technical institute;
47+ (2) be governed by a board or other governing
48+ structure that includes recognized leaders of broad-based
49+ community organizations and members of the local business
50+ community;
51+ (3) demonstrate to the satisfaction of the advisory
52+ board that the organization's program has achieved or will achieve
53+ the following measures of success among program participants to the
54+ extent applicable to the type of program the organization provides:
55+ (A) above-average completion of developmental
56+ education among participating public junior college or public
57+ technical institute students;
58+ (B) above-average persistence rates among
59+ participating public junior college or public technical institute
60+ students;
61+ (C) above-average certificate or degree
62+ completion rates by participating students within a three-year
63+ period compared to demographically comparable public junior
64+ college and public technical institute students; and
65+ (D) employment of participating students at an
66+ average full-time starting wage that is equal to or greater than the
67+ prevailing wage for the occupation entered; and
68+ (4) provide matching funds in accordance with rules
69+ adopted under Section 134.008.
70+ (c) The matching funds required under Subsection (b)(4) may
71+ be obtained from any source available to the nonprofit
72+ organization, including in-kind contributions, community or
73+ foundation grants, individual contributions, and local
74+ governmental agency operating funds.
75+ (d) Grants awarded under this section must be awarded in a
76+ manner that takes a balanced geographical distribution into
77+ consideration.
78+ SECTION 4. Sections 134.006(a) and (d), Education Code, are
2779 amended to read as follows:
2880 (a) The commission may award a grant for the development of
2981 new career and technical education courses or programs at public
3082 junior colleges, public technical institutes, public state
3183 colleges, [and] independent school districts, and open-enrollment
3284 charter schools.
3385 (d) To be eligible to receive a grant under this section, a
3486 public junior college, public technical institute, public state
3587 college, or independent school district or open-enrollment charter
3688 school described under Section 134.007 must provide matching funds
3789 in accordance with rules adopted under Section 134.008. The
3890 matching funds may be obtained from any source available to the
3991 public junior college, public technical institute, public state
4092 college, [or] independent school district, or open-enrollment
4193 charter school, including industry consortia, community or
4294 foundation grants, individual contributions, and local
4395 governmental agency operating funds.
44- SECTION 3. Section 134.007, Education Code, is amended to

49101 school under this chapter if the district or school has entered into
50102 a partnership with a public junior college, public technical
51103 institute, or public state college for the purpose of:
52104 (1) promoting career and technical education to the
53105 district's or school's students; or
54106 (2) offering dual credit courses to the district's or
55107 school's students.
56- SECTION 4. This Act takes effect immediately if it receives

58110 provided by Section 39, Article III, Texas Constitution. If this
59111 Act does not receive the vote necessary for immediate effect, this
