| 8 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 8 | | SECTION 1. Subchapter A, Chapter 822, Health and Safety |
|---|
| 10 | 9 | | Code, is amended by adding Section 822.008 to read as follows: |
|---|
| 11 | 10 | | Sec. 822.008. ANNUAL REPORT OF DOG BITES. Each animal |
|---|
| 12 | 11 | | control authority shall submit to the Department of State Health |
|---|
| 13 | 12 | | Services in the form and manner prescribed by the department an |
|---|
| 14 | 13 | | annual report regarding dog bites that occurred in the preceding |
|---|
| 15 | 14 | | year in the authority's jurisdiction and resulted in bodily injury, |
|---|
| 16 | 15 | | serious bodily injury, or death of a person. The report must |
|---|
| 17 | 16 | | include the following information for each dog bite: |
|---|
| 18 | 17 | | (1) the date of the dog bite; |
|---|
| 19 | 18 | | (2) the county or municipality in which the dog bite |
|---|
| 20 | 19 | | occurred; |
|---|
| 21 | 20 | | (3) the age of the victim of the dog bite; |
|---|
| 22 | 21 | | (4) the breed of the dog that caused the dog bite; |
|---|
| 23 | 22 | | (5) whether the dog bite resulted in bodily injury, |
|---|
| 24 | 23 | | serious bodily injury, or death; |
|---|
| 25 | 24 | | (6) whether the victim as a result of the injuries |
|---|
| 26 | 25 | | sustained received: |
|---|
| 27 | 26 | | (A) emergency medical treatment at an emergency |
|---|
| 28 | 27 | | medical care facility or hospital emergency room; or |
|---|
| 29 | 28 | | (B) inpatient treatment at a hospital; |
|---|
| 30 | 29 | | (7) whether the dog was previously determined to be a |
|---|
| 31 | 30 | | dangerous dog under Subchapter D; |
|---|
| 32 | 31 | | (8) whether the dog had previously bitten a person, |
|---|
| 33 | 32 | | resulting in bodily injury, serious bodily injury, or death; and |
|---|
| 34 | 33 | | (9) whether as a result of the dog bite a person was |
|---|
| 35 | 34 | | charged with a criminal offense under this chapter or any other law. |
|---|
| 36 | 35 | | SECTION 2. Notwithstanding Section 822.008, Health and |
|---|
| 37 | 36 | | Safety Code, as added by this Act, an animal control authority is |
|---|
| 38 | 37 | | not required to submit a report until December 1, 2022. |

| 39 | 38 | | SECTION 3. This Act takes effect September 1, 2021. |
