76 relating to an annual report regarding certain dog bites.
87 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
98 SECTION 1. Subchapter A, Chapter 822, Health and Safety
109 Code, is amended by adding Section 822.008 to read as follows:
1110 Sec. 822.008. ANNUAL REPORT OF DOG BITES. Each animal
1211 control authority shall submit to the Department of State Health
1312 Services in the form and manner prescribed by the department an
1413 annual report regarding dog bites that occurred in the preceding
1514 year in the authority's jurisdiction and resulted in bodily injury,
1615 serious bodily injury, or death of a person. The report must
1716 include the following information for each dog bite:
1817 (1) the date of the dog bite;
1918 (2) the county or municipality in which the dog bite
2019 occurred;
2120 (3) the age of the victim of the dog bite;
2221 (4) the breed of the dog that caused the dog bite;
2322 (5) whether the dog bite resulted in bodily injury,
2423 serious bodily injury, or death;
2524 (6) whether the victim as a result of the injuries
2625 sustained received:
2726 (A) emergency medical treatment at an emergency
2827 medical care facility or hospital emergency room; or
2928 (B) inpatient treatment at a hospital;
3029 (7) whether the dog was previously determined to be a
3130 dangerous dog under Subchapter D;
3231 (8) whether the dog had previously bitten a person,
3332 resulting in bodily injury, serious bodily injury, or death; and
3433 (9) whether as a result of the dog bite a person was
3534 charged with a criminal offense under this chapter or any other law.
3635 SECTION 2. Notwithstanding Section 822.008, Health and
3736 Safety Code, as added by this Act, an animal control authority is
3837 not required to submit a report until December 1, 2022.
3938 SECTION 3. This Act takes effect September 1, 2021.
