46 AN ACT
57 relating to the temporary relocation of a residential child-care
68 facility during a declared state of disaster.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 42.048, Human Resources Code, is amended
911 by amending Subsection (e) and adding Subsection (e-4) to read as
1012 follows:
1113 (e) A license issued under this chapter is not transferable
1214 and applies only to the operator and facility location stated in the
1315 license application. Except as provided by Subsections (e-1),
1416 (e-2), [and] (e-3), and (e-4), a change in location or ownership
1517 automatically revokes a license.
1618 (e-4) To the extent necessary to comply with a state or
1719 local order during a declared state of disaster under Chapter 418,
1820 Government Code, the commission may authorize a residential
1921 child-care facility to temporarily:
2022 (1) relocate to a new location that is not stated in
2123 the facility's license application; or
2224 (2) provide care to one or more children at an
2325 additional location that is not stated in the facility's license
2426 application.
2527 SECTION 2. This Act takes effect immediately if it receives
2628 a vote of two-thirds of all the members elected to each house, as
2729 provided by Section 39, Article III, Texas Constitution. If this
2830 Act does not receive the vote necessary for immediate effect, this
2931 Act takes effect September 1, 2021.
