S.B. No. 863 AN ACT relating to the temporary relocation of a residential child-care facility during a declared state of disaster. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 42.048, Human Resources Code, is amended by amending Subsection (e) and adding Subsection (e-4) to read as follows: (e) A license issued under this chapter is not transferable and applies only to the operator and facility location stated in the license application. Except as provided by Subsections (e-1), (e-2), [and] (e-3), and (e-4), a change in location or ownership automatically revokes a license. (e-4) To the extent necessary to comply with a state or local order during a declared state of disaster under Chapter 418, Government Code, the commission may authorize a residential child-care facility to temporarily: (1) relocate to a new location that is not stated in the facility's license application; or (2) provide care to one or more children at an additional location that is not stated in the facility's license application. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.
