| 7 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 12 | | SECTION 1. Article I, Texas Constitution, is amended by |
|---|
| 9 | 13 | | adding Section 35 to read as follows: |
|---|
| 10 | 14 | | Sec. 35. (a) A resident of a nursing facility, assisted |
|---|
| 11 | 15 | | living facility, intermediate care facility for individuals with an |
|---|
| 12 | 16 | | intellectual disability, residence providing home and |
|---|
| 13 | 17 | | community-based services, or state supported living center, as |
|---|
| 14 | 18 | | those terms are defined by general law, has the right to designate |
|---|
| 15 | 19 | | an essential caregiver with whom the facility, residence, or center |
|---|
| 16 | 20 | | may not prohibit in-person visitation. |
|---|
| 17 | 21 | | (b) Notwithstanding Subsection (a) of this section, the |
|---|
| 18 | 22 | | legislature by general law may provide guidelines for a facility, |
|---|
| 19 | 23 | | residence, or center described by Subsection (a) of this section to |
|---|
| 20 | 24 | | follow in establishing essential caregiver visitation policies and |
|---|
| 21 | 25 | | procedures. |
|---|
| 22 | 26 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 23 | 27 | | submitted to the voters at an election to be held November 2, 2021. |
|---|
| 24 | 28 | | The ballot shall be printed to permit voting for or against the |
|---|
| 25 | 29 | | proposition: "The constitutional amendment establishing a right |
|---|
| 26 | 30 | | for residents of certain facilities to designate an essential |
|---|
| 27 | 31 | | caregiver for in-person visitation." |
