5	8		relating to the composition of districts for the election of
6	9		members of the State Board of Education.
7	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	11		ARTICLE I
9	12		SECTION 1. (a) The members of the State Board of Education
10	13		are elected from the districts described by Article II of this Act.
11	14		(b) One member is elected from each district established by
12	15		this Act.
13	16		(c) For purposes of Section 7.104, Education Code, this Act
14	17		constitutes a decennial reapportionment.

1891	1894		SECTION 1. In this Act, "tract," "block group," and "block"
1892	1895		mean the geographic areas identified by those terms on the 2020
1893	1896		Census TIGER/Line Shapefiles, prepared by the federal Bureau of the
1894	1897		Census for the Twenty-fourth Decennial Census of the United States,
1895	1898		enumerated as of April 1, 2020.
1896	1899		SECTION 2. It is the intent of the legislature that if any
1897	1900		county, tract, block group, block, or other geographic area has
1898	1901		erroneously been left out of this Act, a court reviewing this Act
1899	1902		should include that area in the appropriate district in accordance
1900	1903		with the intent of the legislature, using any available evidence of
1901	1904		that intent, including evidence such as that used by the Supreme
1902	1905		Court of Texas in Smith v. Patterson, 111 Tex. 535, 242 S.W. 749
1903	1906		(1922).
1904	1907		SECTION 3. (a) This Act supersedes all previous enactments
1905	1908		or orders adopting districts for the State Board of Education. All
1906	1909		previous acts of the legislature adopting districts for the State
1907	1910		Board of Education are repealed.
1908	1911		(b) Chapter 72 (H.B. 600), Acts of the 82nd Legislature,
1909	1912		Regular Session, 2011, is repealed.
1910	1913		SECTION 4. The districts set out in Article II of this Act
1911	1914		apply to the election of the members of the State Board of Education
1912	1915		beginning with the primary and general elections in 2022 for
1913	1916		members of the board in 2023. This Act does not affect the
1914	1917		membership or districts of the board before January 1, 2023.
1915	1918		SECTION 5. This Act takes effect immediately if it receives
1916	1919		a vote of two-thirds of all the members elected to each house, as
1917	1920		provided by Section 39, Article III, Texas Constitution. If this
1918	1921		Act does not receive the vote necessary for immediate effect, this
1919	1922		Act takes effect on the 91st day after the last day of the
1920	1923		legislative session.
