99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the period for which a person is required to register as
1212 a sex offender based on the offense of compelling prostitution.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Article 62.101(a), Code of Criminal Procedure,
1515 is amended to read as follows:
1616 (a) Except as provided by Subsection (b) and Subchapter I,
1717 the duty to register for a person ends when the person dies if the
1818 person has a reportable conviction or adjudication, other than an
1919 adjudication of delinquent conduct, for:
2020 (1) a sexually violent offense;
2121 (2) an offense under Section 20A.02(a)(3), (4), (7),
2222 or (8), 25.02, 43.05 [43.05(a)(2)], or 43.26, Penal Code;
2323 (3) an offense under Section 20A.03, Penal Code, if
2424 based partly or wholly on conduct that constitutes an offense under
2525 Section 20A.02(a)(3), (4), (7), or (8) of that code;
2626 (4) an offense under Section 21.11(a)(2), Penal Code,
2727 if before or after the person is convicted or adjudicated for the
2828 offense under Section 21.11(a)(2), Penal Code, the person receives
2929 or has received another reportable conviction or adjudication,
3030 other than an adjudication of delinquent conduct, for an offense or
3131 conduct that requires registration under this chapter;
3232 (5) an offense under Section 20.02, 20.03, or 20.04,
3333 Penal Code, if:
3434 (A) the judgment in the case contains an
3535 affirmative finding under Article 42.015 or, for a deferred
3636 adjudication, the papers in the case contain an affirmative finding
3737 that the victim or intended victim was younger than 17 years of age;
3838 and
3939 (B) before or after the person is convicted or
4040 adjudicated for the offense under Section 20.02, 20.03, or 20.04,
4141 Penal Code, the person receives or has received another reportable
4242 conviction or adjudication, other than an adjudication of
4343 delinquent conduct, for an offense or conduct that requires
4444 registration under this chapter; or
4545 (6) an offense under Section 43.23, Penal Code, that
4646 is punishable under Subsection (h) of that section.
4747 SECTION 2. Article 62.101(a), Code of Criminal Procedure,
4848 as amended by this Act, applies only to a conviction or adjudication
4949 for an offense committed on or after the effective date of this Act.
5050 A conviction or adjudication for an offense committed before the
5151 effective date of this Act is governed by the law in effect on the
5252 date the offense was committed, and the former law is continued in
5353 effect for that purpose. For purposes of this section, an offense
5454 was committed before the effective date of this Act if any element
5555 of the offense occurred before that date.
5656 SECTION 3. This Act takes effect September 1, 2023.
