55 AN ACT
66 relating to certain requirements and procedures regarding the
77 posting of a school district's employment policy.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 11.1513, Education Code, is amended by
1010 amending Subsections (d), (e), and (k) and adding Subsection (l) to
1111 read as follows:
1212 (d) The employment policy must provide that not later than
1313 the fifth [10th] school day before the date on which a district
1414 fills a vacant position for which a certificate or license is
1515 required as provided by Section 21.003, other than a position that
1616 affects the safety and security of students as determined by the
1717 board of trustees, the district must provide to each current
1818 district employee:
1919 (1) notice of the position by posting the position on:
2020 (A) a bulletin board at:
2121 (i) a place convenient to the public in the
2222 district's central administrative office; and
2323 (ii) the central administrative office of
2424 each campus in the district during any time the office is open; or
2525 (B) the district's Internet website, if the
2626 district has a website; and
2727 (2) a reasonable opportunity to apply for the
2828 position.
2929 (e) If, during the school year, the district must fill a
3030 vacant position held by a teacher, as defined by Section 21.201, in
3131 less than five [10] school days, the district:
3232 (1) must provide notice of the position in the manner
3333 described by Subsection (d)(1) as soon as possible after the
3434 vacancy occurs;
3535 (2) is not required to provide the notice for five [10]
3636 school days before filling the position; and
3737 (3) is not required to comply with Subsection (d)(2).
3838 (k) A school district shall post on the district's Internet
3939 website, if the district has a website, the employment policy
4040 adopted by the district's board of trustees under Subsection (a)
4141 and the full text of any regulations referenced in the policy. For
4242 the purposes of this section, regulations include any written
4343 document issued pursuant to a delegation of authority by a
4444 district's board of trustees or that implements a policy adopted by
4545 a district's board of trustees, including compensation plans,
4646 employee leave conditions and procedures, and professional
4747 development requirements. A school district shall make available
4848 any forms referenced in the policy:
4949 (1) on an intranet website that is maintained by the
5050 district and accessible to district employees; or
5151 (2) if the district does not maintain an intranet
5252 website described by Subdivision (1), at a district administrative
5353 office designated by the district.
5454 (l) A grievance presented by a district employee that is
5555 based on a violation of a regulation referenced in the employment
5656 policy adopted by the district's board of trustees under Subsection
5757 (a) must be considered timely regardless of when the grievance is
5858 presented if the school district has not:
5959 (1) complied with the requirements of Subsection (k);
6060 or
6161 (2) provided a copy of the regulation to the employee
6262 presenting the grievance.
6363 SECTION 2. This Act takes effect September 1, 2023.
