6 | 6 | | relating to certain requirements and procedures regarding the |
---|
7 | 7 | | posting of a school district's employment policy. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
9 | 9 | | SECTION 1. Section 11.1513, Education Code, is amended by |
---|
10 | 10 | | amending Subsections (d), (e), and (k) and adding Subsection (l) to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (d) The employment policy must provide that not later than |
---|
13 | 13 | | the fifth [10th] school day before the date on which a district |
---|
14 | 14 | | fills a vacant position for which a certificate or license is |
---|
15 | 15 | | required as provided by Section 21.003, other than a position that |
---|
16 | 16 | | affects the safety and security of students as determined by the |
---|
17 | 17 | | board of trustees, the district must provide to each current |
---|
18 | 18 | | district employee: |
---|
19 | 19 | | (1) notice of the position by posting the position on: |
---|
20 | 20 | | (A) a bulletin board at: |
---|
21 | 21 | | (i) a place convenient to the public in the |
---|
22 | 22 | | district's central administrative office; and |
---|
23 | 23 | | (ii) the central administrative office of |
---|
24 | 24 | | each campus in the district during any time the office is open; or |
---|
25 | 25 | | (B) the district's Internet website, if the |
---|
26 | 26 | | district has a website; and |
---|
27 | 27 | | (2) a reasonable opportunity to apply for the |
---|
28 | 28 | | position. |
---|
29 | 29 | | (e) If, during the school year, the district must fill a |
---|
30 | 30 | | vacant position held by a teacher, as defined by Section 21.201, in |
---|
31 | 31 | | less than five [10] school days, the district: |
---|
32 | 32 | | (1) must provide notice of the position in the manner |
---|
33 | 33 | | described by Subsection (d)(1) as soon as possible after the |
---|
34 | 34 | | vacancy occurs; |
---|
35 | 35 | | (2) is not required to provide the notice for five [10] |
---|
36 | 36 | | school days before filling the position; and |
---|
37 | 37 | | (3) is not required to comply with Subsection (d)(2). |
---|
38 | 38 | | (k) A school district shall post on the district's Internet |
---|
39 | 39 | | website, if the district has a website, the employment policy |
---|
40 | 40 | | adopted by the district's board of trustees under Subsection (a) |
---|
41 | 41 | | and the full text of any regulations referenced in the policy. For |
---|
42 | 42 | | the purposes of this section, regulations include any written |
---|
43 | 43 | | document issued pursuant to a delegation of authority by a |
---|
44 | 44 | | district's board of trustees or that implements a policy adopted by |
---|
45 | 45 | | a district's board of trustees, including compensation plans, |
---|
46 | 46 | | employee leave conditions and procedures, and professional |
---|
47 | 47 | | development requirements. A school district shall make available |
---|
48 | 48 | | any forms referenced in the policy: |
---|
49 | 49 | | (1) on an intranet website that is maintained by the |
---|
50 | 50 | | district and accessible to district employees; or |
---|
51 | 51 | | (2) if the district does not maintain an intranet |
---|
52 | 52 | | website described by Subdivision (1), at a district administrative |
---|
53 | 53 | | office designated by the district. |
---|
54 | 54 | | (l) A grievance presented by a district employee that is |
---|
55 | 55 | | based on a violation of a regulation referenced in the employment |
---|
56 | 56 | | policy adopted by the district's board of trustees under Subsection |
---|
57 | 57 | | (a) must be considered timely regardless of when the grievance is |
---|
58 | 58 | | presented if the school district has not: |
---|
59 | 59 | | (1) complied with the requirements of Subsection (k); |
---|
60 | 60 | | or |
---|
61 | 61 | | (2) provided a copy of the regulation to the employee |
---|
62 | 62 | | presenting the grievance. |
---|
63 | 63 | | SECTION 2. This Act takes effect September 1, 2023. |
