1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to rules regarding the provision by a health professional
1414 of a telemedicine medical service, teledentistry dental service, or
1515 telehealth service.
1616 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1717 SECTION 1. Section 111.004, Occupations Code, is amended by
1818 adding Subsections (c), (d), and (e) to read as follows:
1919 (c) Each agency with regulatory authority over a health
2020 professional providing a telemedicine medical service,
2121 teledentistry dental service, or telehealth service shall adopt
2222 rules necessary to standardize formats for and retention of records
2323 related to a patient's consent to:
2424 (1) treatment;
2525 (2) data collection; and
2626 (3) data sharing.
2727 (d) Rules adopted under Subsection (c) must:
2828 (1) as applicable, address the specific consent
2929 documentation required for:
3030 (A) telemedicine medical services;
3131 (B) teledentistry dental services; or
3232 (C) telehealth services; and
3333 (2) include provisions, based on the appropriate
3434 standard of care, for consent documentation in an audio-only
3535 format.
3636 (e) Rules adopted under this section must require that a
3737 health professional conduct an in-person examination of a patient
3838 before an irreversible medical procedure is initiated.
3939 SECTION 2. This Act takes effect September 1, 2023.
