| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article 43.141, Code of Criminal Procedure, is |

| 11 | 11 | | amended by adding Subsection (d-1) to read as follows: |
|---|
| 12 | 12 | | (d-1) On the motion of the attorney representing the state, |
|---|
| 13 | 13 | | the convicting court shall withdraw the order of the court setting a |
|---|
| 14 | 14 | | date for execution in a death penalty case. |
|---|
| 15 | 15 | | SECTION 2. Article 43.141(d-1), Code of Criminal Procedure, |
|---|
| 16 | 16 | | as added by this Act, applies only to an order entered on or after |
|---|
| 17 | 17 | | the effective date of this Act. An order entered before the |
|---|
| 18 | 18 | | effective date of this Act is governed by the law in effect on the |
|---|
| 19 | 19 | | date the order was entered, and the former law is continued in |
|---|
| 20 | 20 | | effect for that purpose. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect September 1, 2023. |
