55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the withdrawal of an execution date on the motion of the
88 attorney representing the state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 43.141, Code of Criminal Procedure, is
1111 amended by adding Subsection (d-1) to read as follows:
1212 (d-1) On the motion of the attorney representing the state,
1313 the convicting court shall withdraw the order of the court setting a
1414 date for execution in a death penalty case.
1515 SECTION 2. Article 43.141(d-1), Code of Criminal Procedure,
1616 as added by this Act, applies only to an order entered on or after
1717 the effective date of this Act. An order entered before the
1818 effective date of this Act is governed by the law in effect on the
1919 date the order was entered, and the former law is continued in
2020 effect for that purpose.
2121 SECTION 3. This Act takes effect September 1, 2023.
