27 | 27 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

28 | 28 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
---|
29 | 29 | | amended by adding Section 531.09936 to read as follows: |
---|
30 | 30 | | Sec. 531.09936. GRANT PROGRAM TO FUND MENTAL AND BEHAVIORAL |
---|
31 | 31 | | HEALTH SERVICES BY CERTAIN CHILDREN'S HOSPITALS. (a) In this |
---|
32 | 32 | | section: |
---|
33 | 33 | | (1) "Children's hospital" means a hospital designated |
---|
34 | 34 | | by the Centers for Medicare and Medicaid Services as a children's |
---|
35 | 35 | | hospital that is exempted by that federal agency from payment under |
---|
36 | 36 | | the inpatient prospective payment system under Medicare. |
---|
37 | 37 | | (2) "Grant program" means the grant program |
---|
38 | 38 | | established under Subsection (b). |
---|
39 | 39 | | (b) If and to the extent money is specifically appropriated |
---|
40 | 40 | | to the commission for that purpose, the commission shall establish |
---|
41 | 41 | | a grant program under which the commission provides grants to |
---|
42 | 42 | | children's hospitals that the hospitals may, except as provided by |
---|
43 | 43 | | Subsection (e), use to directly provide mental and behavioral |
---|
44 | 44 | | health services to children in this state. |
---|
45 | 45 | | (c) A children's hospital may apply for a grant under the |
---|
46 | 46 | | grant program in the form and manner prescribed by the commission. |
---|
47 | 47 | | (d) A grant recipient may not use a grant awarded under the |
---|
48 | 48 | | grant program to: |
---|
49 | 49 | | (1) reimburse an expense or pay a cost that a health |
---|
50 | 50 | | benefit plan or other source, including Medicaid, is obligated to |
---|
51 | 51 | | reimburse or pay by law or contract; or |
---|
52 | 52 | | (2) provide mental health services, including |
---|
53 | 53 | | treatments or procedures, to a child that affirm the child's |
---|
54 | 54 | | perception of the child's sex if that perception is inconsistent |
---|
55 | 55 | | with the child's biological sex. |
---|
56 | 56 | | (e) The commission shall monitor and evaluate the use of |
---|
57 | 57 | | money awarded under the grant program to ensure compliance with |
---|
58 | 58 | | this section. |
---|
59 | 59 | | (f) Not later than December 1 of each even-numbered year, |
---|
60 | 60 | | the commission shall submit a biennial report to the legislature on |
---|
61 | 61 | | the performance of the grant program during the preceding two state |
---|
62 | 62 | | fiscal years. The report must include the name of each grant |
---|
63 | 63 | | recipient awarded a grant under the program and the amount of the |
---|
64 | 64 | | recipient's award during the fiscal years covered by the report. |
---|
65 | 65 | | (g) This section expires September 1, 2027. |
---|
66 | 66 | | SECTION 2. This Act takes effect September 1, 2023. |
