2323 AN ACT
2424 relating to a grant program to fund the provision by children's
2525 hospitals of mental and behavioral health services to children in
2626 this state.
2727 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
2828 SECTION 1. Subchapter B, Chapter 531, Government Code, is
2929 amended by adding Section 531.09936 to read as follows:
3030 Sec. 531.09936. GRANT PROGRAM TO FUND MENTAL AND BEHAVIORAL
3131 HEALTH SERVICES BY CERTAIN CHILDREN'S HOSPITALS. (a) In this
3232 section:
3333 (1) "Children's hospital" means a hospital designated
3434 by the Centers for Medicare and Medicaid Services as a children's
3535 hospital that is exempted by that federal agency from payment under
3636 the inpatient prospective payment system under Medicare.
3737 (2) "Grant program" means the grant program
3838 established under Subsection (b).
3939 (b) If and to the extent money is specifically appropriated
4040 to the commission for that purpose, the commission shall establish
4141 a grant program under which the commission provides grants to
4242 children's hospitals that the hospitals may, except as provided by
4343 Subsection (e), use to directly provide mental and behavioral
4444 health services to children in this state.
4545 (c) A children's hospital may apply for a grant under the
4646 grant program in the form and manner prescribed by the commission.
4747 (d) A grant recipient may not use a grant awarded under the
4848 grant program to:
4949 (1) reimburse an expense or pay a cost that a health
5050 benefit plan or other source, including Medicaid, is obligated to
5151 reimburse or pay by law or contract; or
5252 (2) provide mental health services, including
5353 treatments or procedures, to a child that affirm the child's
5454 perception of the child's sex if that perception is inconsistent
5555 with the child's biological sex.
5656 (e) The commission shall monitor and evaluate the use of
5757 money awarded under the grant program to ensure compliance with
5858 this section.
5959 (f) Not later than December 1 of each even-numbered year,
6060 the commission shall submit a biennial report to the legislature on
6161 the performance of the grant program during the preceding two state
6262 fiscal years. The report must include the name of each grant
6363 recipient awarded a grant under the program and the amount of the
6464 recipient's award during the fiscal years covered by the report.
6565 (g) This section expires September 1, 2027.
6666 SECTION 2. This Act takes effect September 1, 2023.
