5	5	relating to the requirements to obtain or renew an athletic trainer
6	6	license.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Sections 38.158(b) and (e), Education Code, are
9	9	amended to read as follows:
10	10	(b) The Texas Department of Licensing and Regulation shall
11	11	require [approve for] athletic trainers to obtain continuing
12	12	education [training courses] in the subject matter of concussions
13	13	[and shall maintain an updated list of individuals and
14	14	organizations authorized by the board to provide the training].
15	15	(e) For purposes of Subsection (c):
16	16	(1) a coach must take a course described by Subsection
17	17	(a);
18	18	(2) an athletic trainer must take[:
19	19	[(A) a course described by Subsection (b); or
20	20	[(B)] a course concerning the subject matter of
21	21	concussions that meets the [has been approved for] continuing
22	22	education requirements set [credit] by the Texas Department of
23	23	Licensing and Regulation under Subsection (b) [appropriate
24	24	licensing authority for the profession]; and
25	25	(3) a school nurse or licensed health care
26	26	professional, other than an athletic trainer, must take:
27	27	(A) a course described by Subsection (a) or (b);
28	28	or
29	29	(B) a course concerning the subject matter of
30	30	concussions that has been approved for continuing education credit
31	31	by the appropriate licensing authority for the profession.
32	32	SECTION 2. Section 451.101(a-1), Occupations Code, is
33	33	amended to read as follows:
34	34	(a-1) The department shall:
35	35	(1) [adopt an official seal;
36	36	[(2)] prescribe the application form for a license
37	37	applicant;
38	38	(2) [(3)] prescribe a suitable form for a license
39	39	certificate;
40	40	(3) [(4)] prepare and conduct an examination for
41	41	license applicants; and
42	42	(4) [(5)] maintain a complete record of all licensed
43	43	athletic trainers[; and
44	44	[(6) annually prepare a roster showing the names and
45	45	addresses of all licensed athletic trainers].
46	46	SECTION 3. Section 451.153, Occupations Code, is amended to
47	47	read as follows:
48	48	Sec. 451.153. APPLICANT QUALIFICATIONS. (a) An applicant
49	49	for an athletic trainer license must:
50	50	(1) have met the athletic training curriculum
51	51	requirements of a college or university approved by the commission
52	52	and give proof of graduation; or
53	53	(2) hold a degree or certificate in physical therapy
54	54	and have completed:
55	55	(A) a basic athletic training course from an
56	56	accredited college or university; and
57	57	(B) an apprenticeship described by Subsection
58	58	(b)[; or
59	59	[(3) have a degree in corrective therapy with at least
60	60	a minor in physical education or health that includes a basic
61	61	athletic training course and meet the apprenticeship requirement or
62	62	any other requirement established by the commission].
63	63	(b) The apprenticeship required to be completed by an
64	64	applicant consists of 720 hours completed in two years under the
65	65	direct supervision of a licensed athletic trainer acceptable to the
66	66	department. [Actual working hours include a minimum of 20 hours a
67	67	week during each fall semester.]
68	68	SECTION 4. Section 451.156, Occupations Code, is amended to
69	69	read as follows:
70	70	Sec. 451.156. REQUIREMENTS FOR LICENSE ISSUANCE. An
71	71	applicant for an athletic trainer license is entitled to receive
72	72	the license if the applicant:
73	73	(1) satisfies the requirements of Section 451.153 [or
74	74	451.154];
75	75	(2) passes the examination required by the department;
76	76	and
77	77	(3) pays the required license fee.
78	78	SECTION 5. Section 451.157(a), Occupations Code, is amended
79	79	to read as follows:
80	80	(a) The department may issue a temporary license to an
81	81	applicant if the applicant satisfies:
82	82	(1) the requirements of Section 451.153 [or 451.154];
83	83	and
84	84	(2) any other requirement established by the
85	85	commission.
86	86	SECTION 6. Section 451.154, Occupations Code, is repealed.
87	87	SECTION 7. This Act takes effect immediately if it receives
88	88	a vote of two-thirds of all the members elected to each house, as
89	89	provided by Section 39, Article III, Texas Constitution. If this
90	90	Act does not receive the vote necessary for immediate effect, this
91	91	Act takes effect September 1, 2023.
