55 relating to the requirements to obtain or renew an athletic trainer

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 38.158(b) and (e), Education Code, are
99 amended to read as follows:
1010 (b) The Texas Department of Licensing and Regulation shall
1111 require [approve for] athletic trainers to obtain continuing
1212 education [training courses] in the subject matter of concussions
1313 [and shall maintain an updated list of individuals and
1414 organizations authorized by the board to provide the training].
1515 (e) For purposes of Subsection (c):
1616 (1) a coach must take a course described by Subsection
1717 (a);
1818 (2) an athletic trainer must take[:
1919 [(A) a course described by Subsection (b); or
2020 [(B)] a course concerning the subject matter of
2121 concussions that meets the [has been approved for] continuing
2222 education requirements set [credit] by the Texas Department of
2323 Licensing and Regulation under Subsection (b) [appropriate
2424 licensing authority for the profession]; and
2525 (3) a school nurse or licensed health care
2626 professional, other than an athletic trainer, must take:
2727 (A) a course described by Subsection (a) or (b);
2828 or
2929 (B) a course concerning the subject matter of
3030 concussions that has been approved for continuing education credit
3131 by the appropriate licensing authority for the profession.
3232 SECTION 2. Section 451.101(a-1), Occupations Code, is
3333 amended to read as follows:
3434 (a-1) The department shall:
3535 (1) [adopt an official seal;
3636 [(2)] prescribe the application form for a license
3737 applicant;
3838 (2) [(3)] prescribe a suitable form for a license
3939 certificate;
4040 (3) [(4)] prepare and conduct an examination for
4141 license applicants; and
4242 (4) [(5)] maintain a complete record of all licensed
4343 athletic trainers[; and
4444 [(6) annually prepare a roster showing the names and
4545 addresses of all licensed athletic trainers].
4646 SECTION 3. Section 451.153, Occupations Code, is amended to
4747 read as follows:
4848 Sec. 451.153. APPLICANT QUALIFICATIONS. (a) An applicant
4949 for an athletic trainer license must:
5050 (1) have met the athletic training curriculum
5151 requirements of a college or university approved by the commission
5252 and give proof of graduation; or
5353 (2) hold a degree or certificate in physical therapy
5454 and have completed:
5555 (A) a basic athletic training course from an
5656 accredited college or university; and
5757 (B) an apprenticeship described by Subsection
5858 (b)[; or
5959 [(3) have a degree in corrective therapy with at least
6060 a minor in physical education or health that includes a basic
6161 athletic training course and meet the apprenticeship requirement or
6262 any other requirement established by the commission].
6363 (b) The apprenticeship required to be completed by an
6464 applicant consists of 720 hours completed in two years under the
6565 direct supervision of a licensed athletic trainer acceptable to the
6666 department. [Actual working hours include a minimum of 20 hours a
6767 week during each fall semester.]
6868 SECTION 4. Section 451.156, Occupations Code, is amended to
6969 read as follows:
7070 Sec. 451.156. REQUIREMENTS FOR LICENSE ISSUANCE. An
7171 applicant for an athletic trainer license is entitled to receive
7272 the license if the applicant:
7373 (1) satisfies the requirements of Section 451.153 [or
7474 451.154];
7575 (2) passes the examination required by the department;
7676 and
7777 (3) pays the required license fee.
7878 SECTION 5. Section 451.157(a), Occupations Code, is amended
7979 to read as follows:
8080 (a) The department may issue a temporary license to an
8181 applicant if the applicant satisfies:
8282 (1) the requirements of Section 451.153 [or 451.154];
8383 and
8484 (2) any other requirement established by the
8585 commission.
8686 SECTION 6. Section 451.154, Occupations Code, is repealed.
8787 SECTION 7. This Act takes effect immediately if it receives
8888 a vote of two-thirds of all the members elected to each house, as
8989 provided by Section 39, Article III, Texas Constitution. If this
9090 Act does not receive the vote necessary for immediate effect, this
9191 Act takes effect September 1, 2023.
