| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 251.002(1), Agriculture Code, is amended |
|---|
| 8 | 8 | | to read as follows: |
|---|
| 9 | 9 | | (1) "Agricultural operation" includes the following |
|---|
| 10 | 10 | | activities: |
|---|
| 11 | 11 | | (A) cultivating the soil; |
|---|
| 12 | 12 | | (B) producing crops for human food, animal feed, |
|---|
| 13 | 13 | | planting seed, or fiber; |
|---|
| 14 | 14 | | (C) floriculture; |
|---|
| 15 | 15 | | (D) viticulture; |
|---|
| 16 | 16 | | (E) horticulture; |
|---|
| 17 | 17 | | (F) silviculture; |
|---|
| 18 | 18 | | (G) wildlife management; |
|---|
| 19 | 19 | | (H) raising or keeping livestock or poultry; |
|---|
| 20 | 20 | | [and] |
|---|
| 21 | 21 | | (I) planting cover crops or leaving land idle for |
|---|
| 22 | 22 | | the purpose of participating in any governmental program or normal |
|---|
| 23 | 23 | | crop or livestock rotation procedure; and |
|---|
| 24 | 24 | | (J) the commercial sale of animals, as defined by |
|---|
| 25 | 25 | | Section 252.001 of this code. |

| 26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2023. |
