| 7 | 7 | | relating to the exemption of certain property from municipal |

| 8 | 8 | | drainage service charges. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 552.053, Local Government Code, is |
|---|
| 11 | 11 | | amended by adding Subsections (d-2) and (d-3) to read as follows: |
|---|
| 12 | 12 | | (d-2) A municipality may exempt property from all or a |
|---|
| 13 | 13 | | portion of drainage charges under Section 552.047 if the property |
|---|
| 14 | 14 | | is used as the principal residence of an individual who is: |
|---|
| 15 | 15 | | (1) disabled as defined by Section 11.13(m), Tax Code; |
|---|
| 16 | 16 | | (2) 65 years of age or older; |
|---|
| 17 | 17 | | (3) a veteran of the armed services of the United |
|---|
| 18 | 18 | | States; or |
|---|
| 19 | 19 | | (4) a member of the armed services of the United States |
|---|
| 20 | 20 | | on active deployment. |
|---|
| 21 | 21 | | (d-3) The municipality may impose additional eligibility |
|---|
| 22 | 22 | | requirements for an exemption authorized under Subsection (d-2). |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
