55 relating to a study on enhancing border security outcomes through
66 public safety, technological, and transportation infrastructure
77 improvements near Texas-Mexico border crossings.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. DEFINITION. In this Act, "department" means the
1010 Texas Department of Transportation.
1111 SECTION 2. STUDY. (a) The department shall conduct a study
1212 on public safety, border security, and transportation
1313 infrastructure from Texas-Mexico border crossings onto the state
1414 highway system to ensure safe, efficient, and streamlined
1515 commercial motor vehicle connectivity that amplify Operation Lone
1616 Star efforts.
1717 (b) The department shall conduct the study in consultation
1818 with:
1919 (1) the Department of Public Safety of the State of
2020 Texas;
2121 (2) the Texas Military Department;
2222 (3) the Texas A&M Transportation Institute;
2323 (4) local law enforcement agencies near the
2424 Texas-Mexico border;
2525 (5) representatives of county government from at least
2626 three noncontiguous counties that are:
2727 (A) adjacent to this state's international
2828 border with Mexico; or
2929 (B) adjacent to a county described by Paragraph
3030 (A) of this subdivision;
3131 (6) representatives of the transportation industry
3232 determined relevant by the department; and
3333 (7) an independent nonprofit applied research and
3434 development organization selected by the department.
3535 (c) As part the study, the department shall:
3636 (1) select multiple Texas-Mexico international border
3737 crossings that serve commercial vehicles, as determined by the
3838 department;
3939 (2) analyze current transportation routes for
4040 commercial vehicles from border crossings selected under
4141 Subdivision (1) of this subsection onto the state highway system
4242 and identify ways to:
4343 (A) strengthen border security initiatives that
4444 support Operation Lone Star or similar state security efforts;
4545 (B) support law enforcement response efforts
4646 near border crossings to maximize:
4747 (i) oversight of border crossings;
4848 (ii) inspection of vehicles using the
4949 border crossing; and
5050 (iii) use of public safety resources;
5151 (C) enhance transportation infrastructure and
5252 road technology near border crossings to:
5353 (i) maximize the safety of communities
5454 located near the border and people using the highways near the
5555 border; and
5656 (ii) improve transportation efficiency and
5757 commercial motor vehicle connectivity; and
5858 (D) reduce traffic congestion along
5959 transportation routes while mitigating safety concerns;
6060 (3) consider possible future transportation routes
6161 that will:
6262 (A) improve efficiency in the movement of
6363 commercial motor vehicles from border crossings onto the state
6464 highway system; and
6565 (B) enhance public safety, mitigate traffic
6666 congestion, and streamline commercial motor vehicle connectivity;
6767 (4) assess current technologies used to promote border
6868 security efforts at commercial inspection facilities at or near
6969 border crossings and identify upgrades to existing technologies or
7070 alternative technologies that may improve border security efforts;
7171 and
7272 (5) identify funding strategies and determine the
7373 amount of state money needed to improve the processing and flow of
7474 commercial motor vehicles at border crossings and improve
7575 transportation efficiency and commercial motor vehicle
7676 connectivity.
7777 SECTION 3. REPORT. Not later than December 1, 2024, the
7878 department shall submit to the governor, the lieutenant governor,
7979 and the legislature a written report on the findings of the study
8080 conducted under this Act and any recommendations of the department.
8181 The report must include a review of the anticipated effects of the
8282 security and public safety improvements recommended by the study on
8383 international trade efforts with Mexico.
8484 SECTION 4. EXPIRATION. This Act expires January 1, 2025.
8585 SECTION 5. EFFECTIVE DATE. This Act takes effect
8686 immediately if it receives a vote of two-thirds of all the members
8787 elected to each house, as provided by Section 39, Article III, Texas
8888 Constitution. If this Act does not receive the vote necessary for
8989 immediate effect, this Act takes effect September 1, 2023.
