| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Subchapter A, Chapter 2165, Government Code, is |
|---|
| 16 | 16 | | amended by adding Section 2165.010 to read as follows: |

| 17 | 17 | | Sec. 2165.010. PLACEMENT OF ELECTRIC VEHICLE CHARGING |
|---|
| 18 | 18 | | EQUIPMENT ON STATE PROPERTY. (a) In this section: |
|---|
| 19 | 19 | | (1) "Charging provider" means a person who provides to |
|---|
| 20 | 20 | | another person the use of electric vehicle charging equipment in a |
|---|
| 21 | 21 | | commercial transaction. |
|---|
| 22 | 22 | | (2) "Electric vehicle charging equipment" means |
|---|
| 23 | 23 | | equipment manufactured for transferring electric energy from |
|---|
| 24 | 24 | | electric supply to an electric vehicle. |
|---|
| 25 | 25 | | (3) "Metering device" means a commercial device used |
|---|
| 26 | 26 | | to measure electric energy transferred by electric vehicle charging |
|---|
| 27 | 27 | | equipment and compute the charge for the transferred energy. |
|---|
| 28 | 28 | | (b) A state agency in charge and control of state property, |
|---|
| 29 | 29 | | including a state park, may enter into an agreement authorizing a |
|---|
| 30 | 30 | | charging provider to place and maintain electric vehicle charging |
|---|
| 31 | 31 | | equipment on the property. |
|---|
| 32 | 32 | | (c) An agreement described by Subsection (b): |
|---|
| 33 | 33 | | (1) must require the charging provider to use a |
|---|
| 34 | 34 | | metering device to determine the cost of electricity transferred to |
|---|
| 35 | 35 | | another person through electric vehicle charging equipment; and |
|---|
| 36 | 36 | | (2) may include any other reasonable requirements on |
|---|
| 37 | 37 | | the use of the property. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2023. |
