68 A JOINT RESOLUTION
79 proposing a constitutional amendment allowing recovery of
810 exemplary damages by parents or a person's estate for a homicide.
911 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 26, Article XVI, Texas Constitution, is
1113 amended to read as follows:
1214 Sec. 26. Every person, corporation, or company, that may
1315 commit a homicide, through wilful act, or omission, or gross
1416 neglect, shall be responsible, in exemplary damages, to the
1517 surviving spouse, children, or parents [husband, widow, heirs of
1618 his or her body], [or] such of them as there may be, or the deceased
1719 person's estate without regard to any criminal proceeding that may
1820 or may not be had in relation to the homicide.
1921 SECTION 2. This proposed constitutional amendment shall be
2022 submitted to the voters at an election to be held November 7, 2023.
2123 The ballot shall be printed to permit voting for or against the
2224 proposition: "The constitutional amendment allowing recovery of
2325 exemplary damages by parents or a person's estate for a homicide."
