9 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 12 | | SECTION 1. Section 26, Article XVI, Texas Constitution, is |

11 | 13 | | amended to read as follows: |

12 | 14 | | Sec. 26. Every person, corporation, or company, that may |
---|
13 | 15 | | commit a homicide, through wilful act, or omission, or gross |
---|
14 | 16 | | neglect, shall be responsible, in exemplary damages, to the |
---|
15 | 17 | | surviving spouse, children, or parents [husband, widow, heirs of |
---|
16 | 18 | | his or her body], [or] such of them as there may be, or the deceased |
---|
17 | 19 | | person's estate without regard to any criminal proceeding that may |
---|
18 | 20 | | or may not be had in relation to the homicide. |
---|
19 | 21 | | SECTION 2. This proposed constitutional amendment shall be |
---|
20 | 22 | | submitted to the voters at an election to be held November 7, 2023. |
---|
21 | 23 | | The ballot shall be printed to permit voting for or against the |
---|
22 | 24 | | proposition: "The constitutional amendment allowing recovery of |
---|
23 | 25 | | exemplary damages by parents or a person's estate for a homicide." |
