6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 7 | | SECTION 1. Section 1701.253, Occupations Code, is amended |
---|
8 | 8 | | by adding Subsection (q) to read as follows: |
---|
9 | 9 | | (q) As part of the minimum curriculum requirements, the |
---|
10 | 10 | | commission shall require an officer to complete a training program |
---|
11 | 11 | | of not less than 16 hours on responding to an active shooter as |
---|
12 | 12 | | developed by the Advanced Law Enforcement Rapid Response Training |
---|
13 | 13 | | Center at Texas State University--San Marcos. An officer shall |
---|
14 | 14 | | complete the program not later than the last day of the first full |
---|
15 | 15 | | continuing education training period that begins on or after the |
---|
16 | 16 | | date the officer is licensed under this chapter unless the officer |
---|
17 | 17 | | completes the program as part of the officer's basic training |
---|
18 | 18 | | course. Completion of a training program under this subsection |
---|
19 | 19 | | satisfies any other requirement, other than a continuing education |
---|
20 | 20 | | requirement under Section 1701.3525, for the officer to complete a |
---|
21 | 21 | | training program on responding to active shootings, including under |
---|
22 | 22 | | Section 37.0812(a), Education Code. |
---|
23 | 23 | | SECTION 2. Subchapter H, Chapter 1701, Occupations Code, is |
---|
24 | 24 | | amended by adding Section 1701.3525 to read as follows: |
---|
25 | 25 | | Sec. 1701.3525. ACTIVE SHOOTER RESPONSE TRAINING REQUIRED |
---|
26 | 26 | | FOR OFFICERS. (a) As part of the continuing education programs |
---|
27 | 27 | | under Section 1701.351(a), an officer must complete not less than |
---|
28 | 28 | | 16 hours of training on responding to an active shooter as developed |
---|
29 | 29 | | by the Advanced Law Enforcement Rapid Response Training Center at |
---|
30 | 30 | | Texas State University--San Marcos. |
---|
31 | 31 | | (b) The exemptions under Sections 1701.351(b), (c), and (d) |
---|
32 | 32 | | do not apply to the training required by Subsection (a). |
---|
33 | 33 | | SECTION 3. As soon as practicable after the effective date |
---|
34 | 34 | | of this Act, the Texas Commission on Law Enforcement shall adopt |
---|
35 | 35 | | rules to implement Sections 1701.253(q) and 1701.3525, Occupations |
---|
36 | 36 | | Code, as added by this Act. |
---|
37 | 37 | | SECTION 4. The minimum curriculum requirements under |
---|
38 | 38 | | Section 1701.253(q), Occupations Code, as added by this Act, apply |
---|
39 | 39 | | only to an officer who first begins to satisfy those requirements on |
---|
40 | 40 | | or after January 1, 2024. |
---|
41 | 41 | | SECTION 5. Section 1701.3525, Occupations Code, as added by |
---|
42 | 42 | | this Act, applies only with respect to a 24-month continuing |
---|
43 | 43 | | education training unit that begins on or after the effective date |
---|
44 | 44 | | of this Act. A training unit that begins before the effective date |
---|
45 | 45 | | of this Act is governed by the law in effect on the date the training |
---|
46 | 46 | | unit began, and the former law is continued in effect for that |
---|
47 | 47 | | purpose. |
---|
48 | 48 | | SECTION 6. This Act takes effect September 1, 2023. |
