55 relating to active shooter training for peace officers.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 1701.253, Occupations Code, is amended
88 by adding Subsection (q) to read as follows:
99 (q) As part of the minimum curriculum requirements, the
1010 commission shall require an officer to complete a training program
1111 of not less than 16 hours on responding to an active shooter as
1212 developed by the Advanced Law Enforcement Rapid Response Training
1313 Center at Texas State University--San Marcos. An officer shall
1414 complete the program not later than the last day of the first full
1515 continuing education training period that begins on or after the
1616 date the officer is licensed under this chapter unless the officer
1717 completes the program as part of the officer's basic training
1818 course. Completion of a training program under this subsection
1919 satisfies any other requirement, other than a continuing education
2020 requirement under Section 1701.3525, for the officer to complete a
2121 training program on responding to active shootings, including under
2222 Section 37.0812(a), Education Code.
2323 SECTION 2. Subchapter H, Chapter 1701, Occupations Code, is
2424 amended by adding Section 1701.3525 to read as follows:
2525 Sec. 1701.3525. ACTIVE SHOOTER RESPONSE TRAINING REQUIRED
2626 FOR OFFICERS. (a) As part of the continuing education programs
2727 under Section 1701.351(a), an officer must complete not less than
2828 16 hours of training on responding to an active shooter as developed
2929 by the Advanced Law Enforcement Rapid Response Training Center at
3030 Texas State University--San Marcos.
3131 (b) The exemptions under Sections 1701.351(b), (c), and (d)
3232 do not apply to the training required by Subsection (a).
3333 SECTION 3. As soon as practicable after the effective date
3434 of this Act, the Texas Commission on Law Enforcement shall adopt
3535 rules to implement Sections 1701.253(q) and 1701.3525, Occupations
3636 Code, as added by this Act.
3737 SECTION 4. The minimum curriculum requirements under
3838 Section 1701.253(q), Occupations Code, as added by this Act, apply
3939 only to an officer who first begins to satisfy those requirements on
4040 or after January 1, 2024.
4141 SECTION 5. Section 1701.3525, Occupations Code, as added by
4242 this Act, applies only with respect to a 24-month continuing
4343 education training unit that begins on or after the effective date
4444 of this Act. A training unit that begins before the effective date
4545 of this Act is governed by the law in effect on the date the training
4646 unit began, and the former law is continued in effect for that
4747 purpose.
4848 SECTION 6. This Act takes effect September 1, 2023.
