77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Title 4, Health and Safety Code, is amended by
99 adding Subtitle H to read as follows:
1010 SUBTITLE H. HEALTH FACILITY EMPLOYEES
1111 CHAPTER 331. WORKPLACE VIOLENCE PREVENTION
1212 Sec. 331.001. DEFINITIONS. In this chapter:
1313 (1) "Commission" means the Health and Human Services
1414 Commission.
1515 (2) "Committee" means the workplace violence
1616 prevention committee or other committee responsible for developing
1717 a facility's workplace violence prevention plan under Section
1818 331.002.
1919 (3) "Facility" means:
2020 (A) a home and community support services agency
2121 licensed or licensed and certified under Chapter 142 to provide
2222 home health services as defined by Section 142.001 that employs at
2323 least two registered nurses;
2424 (B) a hospital licensed under Chapter 241 and a
2525 hospital maintained or operated by an agency of this state that is
2626 exempt from licensing under that chapter;
2727 (C) a nursing facility licensed under Chapter 242
2828 that employs at least two registered nurses;
2929 (D) an ambulatory surgical center licensed under
3030 Chapter 243;
3131 (E) a freestanding emergency medical care
3232 facility as defined by Section 254.001; and
3333 (F) a mental hospital licensed under Chapter 577.
3434 Sec. 331.002. WORKPLACE VIOLENCE PREVENTION COMMITTEE. (a)
3535 Each facility shall establish a workplace violence prevention
3636 committee or authorize an existing facility committee to develop
3737 the workplace violence prevention plan required under Section
3838 331.004.
3939 (b) A committee must include at least:
4040 (1) one registered nurse who provides direct care to
4141 patients of the facility;
4242 (2) except as provided by Subsection (c), one
4343 physician licensed to practice medicine in this state who provides
4444 direct care to patients of the facility; and
4545 (3) one facility employee who provides security
4646 services for the facility if any and if practicable.
4747 (c) If a facility described by Section 331.001(3)(A) does
4848 not have on staff at least one physician described by Subsection
4949 (b)(2), the facility is not required to include a physician on the
5050 committee.
5151 (d) A health care system that owns or operates more than one
5252 facility may establish a single committee for all of the system's
5353 facilities if:
5454 (1) the committee develops a violence prevention plan
5555 for implementation at each facility in the system; and
5656 (2) data related to violence prevention remains
5757 distinctly identifiable for each facility in the system.
5858 Sec. 331.003. WORKPLACE VIOLENCE PREVENTION POLICY. (a) A
5959 facility shall adopt, implement, and enforce a written workplace
6060 violence prevention policy in accordance with this section to
6161 protect health care providers and employees from violent behavior
6262 and threats of violent behavior occurring at the facility.
6363 (b) The workplace violence prevention policy must:
6464 (1) require the facility to:
6565 (A) provide significant consideration of the
6666 violence prevention plan recommended by the facility's committee;
6767 and
6868 (B) evaluate any existing facility violence
6969 prevention plan;
7070 (2) encourage health care providers and employees of
7171 the facility to provide confidential information on workplace
7272 violence to the committee;
7373 (3) include a process to protect from retaliation
7474 facility health care providers or employees who provide information
7575 to the committee; and
7676 (4) comply with commission rules relating to workplace
7777 violence.
7878 Sec. 331.004. WORKPLACE VIOLENCE PREVENTION PLAN. (a) A
7979 facility shall adopt, implement, and enforce a written workplace
8080 violence prevention plan in accordance with this section to protect
8181 health care providers and employees from violent behavior and
8282 threats of violent behavior occurring at the facility.
8383 (b) A facility's workplace violence prevention plan must:
8484 (1) be based on the practice setting;
8585 (2) adopt a definition of "workplace violence" that
8686 includes:
8787 (A) an act or threat of physical force against a
8888 health care provider or employee that results in, or is likely to
8989 result in, physical injury or psychological trauma; and
9090 (B) an incident involving the use of a firearm or
9191 other dangerous weapon, regardless of whether a health care
9292 provider or employee is injured by the weapon;
9393 (3) require the facility to provide at least annually
9494 workplace violence prevention training or education that may be
9595 included in other required training or education provided to the
9696 facility's health care providers and employees who provide direct
9797 patient care;
9898 (4) prescribe a system for responding to and
9999 investigating violent incidents or potentially violent incidents
100100 at the facility;
101101 (5) address physical security and safety;
102102 (6) require the facility to solicit information from
103103 health care providers and employees when developing and
104104 implementing a workplace violence prevention plan;
105105 (7) allow health care providers and employees to
106106 report incidents of workplace violence through the facility's
107107 existing occurrence reporting systems; and
108108 (8) require the facility to adjust patient care
109109 assignments, to the extent practicable, to prevent a health care
110110 provider or employee of the facility from treating or providing
111111 services to a patient who has intentionally physically abused or
112112 threatened the provider or employee.
113113 (c) The written workplace violence prevention plan may
114114 satisfy the requirements of Subsection (b) by referencing other
115115 internal facility policies and documents.
116116 (d) A committee at least annually shall:
117117 (1) review and evaluate the workplace violence
118118 prevention plan; and
119119 (2) report the results of the evaluation to the
120120 governing body of the facility.
121121 (e) Each facility shall make available on request an
122122 electronic or printed copy of the facility's workplace violence
123123 prevention plan to each health care provider or employee of the
124124 facility. If the committee determines the plan contains information
125125 that would pose a security threat if made public, the committee may
126126 redact that information before providing the plan.
127127 Sec. 331.005. RESPONDING TO INCIDENT OF WORKPLACE VIOLENCE.
128128 (a) Following an incident of workplace violence, a facility shall
129129 at a minimum offer immediate post-incident services, including any
130130 necessary acute medical treatment for each health care provider or
131131 employee of the facility who is directly involved in the incident.
132132 (b) A facility may not discourage a health care provider or
133133 employee from exercising the provider's or employee's right to
134134 contact or file a report with law enforcement regarding an incident
135135 of workplace violence.
136136 (c) A person may not discipline, including by suspension or
137137 termination of employment, discriminate against, or retaliate
138138 against another person who:
139139 (1) in good faith reports an incident of workplace
140140 violence; or
141141 (2) advises a health care provider or employee of the
142142 provider's or employee's right to report an incident of workplace
143143 violence.
144144 Sec. 331.006. ENFORCEMENT. An appropriate licensing agency
145145 may take disciplinary action against a person who violates this
146146 chapter as if the person violated an applicable licensing law.
147147 SECTION 2. Not later than September 1, 2024, a facility
148148 subject to Chapter 331, Health and Safety Code, as added by this
149149 Act, shall adopt a workplace violence prevention policy and adopt
150150 and implement a workplace violence prevention plan in accordance
151151 with Sections 331.003 and 331.004, Health and Safety Code, as added
152152 by this Act.
153153 SECTION 3. This Act takes effect September 1, 2023.
