8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter D, Chapter 120, Business & Commerce |
---|
10 | 10 | | Code, is amended by adding Sections 120.152 and 120.153 to read as |

11 | 11 | | follows: |

12 | 12 | | Sec. 120.152. ATTORNEY GENERAL INVESTIGATIVE AUTHORITY. If |
---|
13 | 13 | | the attorney general has reason to believe that a person has engaged |
---|
14 | 14 | | in, is engaging in, or is about to engage in a violation of this |
---|
15 | 15 | | chapter, the attorney general may issue a civil investigative |
---|
16 | 16 | | demand. The procedures established for the issuance of a civil |
---|
17 | 17 | | investigative demand under Section 15.10 apply to the same extent |
---|
18 | 18 | | and manner to the issuance of a civil investigative demand under |
---|
19 | 19 | | this section. The attorney general may seek an order from the |
---|
20 | 20 | | district court compelling compliance with a civil investigative |
---|
21 | 21 | | demand issued under this section. |
---|
22 | 22 | | Sec. 120.153. DECEPTIVE TRADE PRACTICE. A violation of |
---|
23 | 23 | | this chapter is a false, misleading, or deceptive act or practice |
---|
24 | 24 | | under Subchapter E, Chapter 17, and is actionable under that |
---|
25 | 25 | | subchapter. |
---|
26 | 26 | | SECTION 2. This Act takes effect September 1, 2023. |
