88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter D, Chapter 120, Business & Commerce
1010 Code, is amended by adding Sections 120.152 and 120.153 to read as
1111 follows:
1212 Sec. 120.152. ATTORNEY GENERAL INVESTIGATIVE AUTHORITY. If
1313 the attorney general has reason to believe that a person has engaged
1414 in, is engaging in, or is about to engage in a violation of this
1515 chapter, the attorney general may issue a civil investigative
1616 demand. The procedures established for the issuance of a civil
1717 investigative demand under Section 15.10 apply to the same extent
1818 and manner to the issuance of a civil investigative demand under
1919 this section. The attorney general may seek an order from the
2020 district court compelling compliance with a civil investigative
2121 demand issued under this section.
2222 Sec. 120.153. DECEPTIVE TRADE PRACTICE. A violation of
2323 this chapter is a false, misleading, or deceptive act or practice
2424 under Subchapter E, Chapter 17, and is actionable under that
2525 subchapter.
2626 SECTION 2. This Act takes effect September 1, 2023.
