46 AN ACT
57 relating to the composition of districts for the election of
68 members of the Texas Senate.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. The purpose of this Act is to ensure the
911 legislature has fulfilled its duty to apportion the state into
1012 senatorial districts at its first regular session after the
1113 publication of the Twenty-fourth Decennial Census of the United
1214 States, as provided by Section 28, Article III, Texas Constitution.
1315 SECTION 2. The districts used to elect members of the Texas
1416 Senate in 2022, established by Chapter 5 (S.B. 4), Acts of the 87th
1517 Legislature, 3rd Called Session, 2021 (PLANS2168 in the Texas
1618 Legislature's redistricting system), are hereby ratified and
1719 adopted as the permanent districts used to elect members of the
1820 Texas Senate.
1921 SECTION 3. The legislature finds that the districts
2022 described by SECTION 2 of this Act are a continuation of the
2123 districts used for the election of the members of the Senate of the
2224 88th Legislature. Accordingly, the legislature finds that
2325 enactment of this Act does not require a new senate be chosen for
2426 the 89th Legislature for purposes of Section 3, Article III, Texas
2527 Constitution. The legislature's findings expressed in this section
2628 are consistent with the opinion of the court of appeals in
2729 Armbrister v. Morales, 943 S.W.2d 202 (Tex. App.-Austin 1997, no
2830 pet.).
2931 SECTION 4. The districts described by SECTION 2 of this Act
3032 apply to the election of the members of the Texas Senate beginning
3133 with the primary and general elections in 2024 for members of the
3234 89th Legislature. This Act does not affect the membership or
3335 districts of the Senate of the 88th Texas Legislature.
3436 SECTION 5. This Act takes effect immediately if it receives
3537 a vote of two-thirds of all the members elected to each house, as
3638 provided by Section 39, Article III, Texas Constitution. If this
3739 Act does not receive the vote necessary for immediate effect, this
3840 Act takes effect September 1, 2023.
