| 11 | 11 | | Session, 2017, enacted S.J.R. No. 38 to officially rescind, repeal, |

| 12 | 12 | | revoke, cancel, void, and nullify certain applications from Texas |
|---|
| 13 | 13 | | legislatures prior to the 85th Legislature, Regular Session, 2017, |
|---|
| 14 | 14 | | that apply to the United States Congress for the calling of a |
|---|
| 15 | 15 | | convention under Article V of the United States Constitution; and |
|---|
| 16 | 16 | | WHEREAS, S.J.R. No. 38 additionally provided that any |
|---|
| 17 | 17 | | application to the United States Congress for the calling of a |
|---|
| 18 | 18 | | convention under Article V of the United States Constitution that |
|---|
| 19 | 19 | | is submitted by the Texas Legislature during or after the Regular |
|---|
| 20 | 20 | | Session of the 85th Legislature will be automatically rescinded, |
|---|
| 21 | 21 | | repealed, revoked, canceled, voided, and nullified if the |
|---|
| 22 | 22 | | applicable convention is not called on or before the eighth |
|---|
| 23 | 23 | | anniversary of the date the last legislative vote is taken on the |
|---|
| 24 | 24 | | application; now, therefore, be it |
|---|
| 25 | 25 | | RESOLVED, That the 88th Legislature of the State of Texas, |
|---|
| 26 | 26 | | Regular Session, 2023, hereby officially rescinds, repeals, |
|---|
| 27 | 27 | | revokes, cancels, voids, and nullifies the provision of S.J.R. |
|---|
| 28 | 28 | | No. 38 that provided for the automatic rescission, repeal, |
|---|
| 29 | 29 | | revocation, cancellation, voiding, and nullification of any |
|---|
| 30 | 30 | | application from the Texas Legislature after the eighth anniversary |
|---|
| 31 | 31 | | of the date the last legislative vote was taken on the application; |
|---|
| 32 | 32 | | and, be it further |

| 33 | 33 | | RESOLVED, That the 88th Legislature of the State of Texas, |

| 34 | 34 | | Regular Session, 2023, hereby declares that any application to the |
|---|
| 35 | 35 | | United States Congress for the calling of a convention under |
|---|
| 36 | 36 | | Article V of the United States Constitution that is submitted by the |
|---|
| 37 | 37 | | Texas Legislature during or after the 85th Legislature of the State |
|---|
| 38 | 38 | | of Texas, Regular Session, 2017, shall be automatically rescinded, |
|---|
| 39 | 39 | | repealed, revoked, canceled, voided, and nullified if the |
|---|
| 40 | 40 | | applicable convention is not called on or before the 16th |
|---|
| 41 | 41 | | anniversary of the date the last legislative vote is taken on the |

| 43 | 43 | | RESOLVED, That the Texas secretary of state forward official |

| 44 | 44 | | copies of this resolution to the president of the United States, to |

| 45 | 45 | | the speaker of the House of Representatives of the United States, to |

| 46 | 46 | | the vice president of the United States in the vice president's |
|---|
| 47 | 47 | | capacity as the presiding officer of the Senate of the United States |
|---|
| 48 | 48 | | at the office located in the United States Capitol Building, and to |
|---|
| 49 | 49 | | all members of the Texas delegation to Congress with the request |
|---|
| 50 | 50 | | that this resolution be officially entered in the Congressional |
