7 | 14 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 15 | | SECTION 1. Article I, Texas Constitution, is amended by |
---|
9 | 16 | | adding Section 36 to read as follows: |
---|
10 | 17 | | Sec. 36. (a) A parent has the inherent right to exercise |
---|
11 | 18 | | care, custody, and control of the parent's child and to make |
---|
12 | 19 | | decisions for the upbringing of the parent's child, including but |
---|
13 | 20 | | not limited to decisions regarding the education, moral and |
---|
14 | 21 | | religious training, and health care of the child. |
---|
15 | 22 | | (b) The state or a political subdivision of this state shall |
---|
16 | 23 | | not interfere with the rights of a parent described by Subsection |
---|
17 | 24 | | (a) of this section unless the interference is: |
---|
18 | 25 | | (1) essential to further a compelling governmental |
---|
19 | 26 | | interest; and |
---|
20 | 27 | | (2) narrowly tailored to accomplish that compelling |
---|
21 | 28 | | governmental interest. |
---|
22 | 29 | | SECTION 2. This proposed constitutional amendment shall be |
---|
23 | 30 | | submitted to the voters at an election to be held November 7, 2023. |
---|
24 | 31 | | The ballot shall be printed to permit voting for or against the |
---|
25 | 32 | | proposition: "The constitutional amendment establishing parents |
---|
26 | 33 | | as the primary decision-makers for their children." |
