7 | 14 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 15 | | SECTION 1. Article III, Texas Constitution, is amended by |
---|
9 | 16 | | adding Section 49-q to read as follows: |
---|
10 | 17 | | Sec. 49-q. (a) The Texas power resiliency fund is created |
---|
11 | 18 | | as a special fund in the state treasury outside the general revenue |
---|
12 | 19 | | fund. |
---|
13 | 20 | | (b) As provided by general law, money in the Texas power |
---|
14 | 21 | | resiliency fund may be used without further appropriation and |
---|
15 | 22 | | administered only by the Texas Division of Emergency Management or |
---|
19 | 26 | | (c) The entity administering the Texas power resiliency |
---|
20 | 27 | | fund may establish separate accounts in the fund as necessary or |
---|
21 | 28 | | convenient for the fund's administration. |
---|
22 | 29 | | (d) The Texas power resiliency fund consists of: |
---|
23 | 30 | | (1) money credited, appropriated, or transferred to |
---|
24 | 31 | | the fund by the legislature; |
---|
25 | 32 | | (2) revenue that the legislature dedicates for deposit |
---|
26 | 33 | | to the credit of the fund; |
---|
27 | 34 | | (3) the returns received from the investment of the |
---|
28 | 35 | | money in the fund; and |
---|
29 | 36 | | (4) gifts, grants, and donations contributed to the |
---|
30 | 37 | | credit of the fund. |
---|
31 | 38 | | (e) The reasonable expenses of managing the fund's assets |
---|
32 | 39 | | shall be paid from the fund. |
---|
33 | 40 | | (f) For purposes of Section 22, Article VIII, of this |
---|
34 | 41 | | constitution: |
---|
35 | 42 | | (1) money in the Texas power resiliency fund is |
---|
36 | 43 | | dedicated by this constitution; and |
---|
37 | 44 | | (2) an appropriation of state tax revenues for the |
---|
38 | 45 | | purpose of depositing money to the credit of the Texas power |
---|
39 | 46 | | resiliency fund is treated as if it were an appropriation of |
---|
40 | 47 | | revenues dedicated by this constitution. |
---|
41 | 48 | | SECTION 2. This proposed constitutional amendment shall be |
---|
42 | 49 | | submitted to the voters at an election to be held November 7, 2023. |
---|
43 | 50 | | The ballot shall be printed to permit voting for or against the |
---|
44 | 51 | | proposition: "The constitutional amendment providing for the |
---|
45 | 52 | | creation of the Texas power resiliency fund to finance backup power |
---|
46 | 53 | | sources." |
