5	5	relating to an appropriation to provide funding for the
6	6	construction, operation, and maintenance of border barrier
7	7	infrastructure and border security operations, including funding
8	8	for additional overtime expenses and costs due to certain increased
9	9	law enforcement presence.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. APPROPRIATION TO TRUSTEED PROGRAMS WITHIN THE
12	12	OFFICE OF THE GOVERNOR. (a) The amount of $1,540,000,000 is
13	13	appropriated from the general revenue fund to the Trusteed Programs
14	14	within the Office of the Governor for use during the two-year period
15	15	beginning on the effective date of this Act for the purpose of
16	16	providing funding for border security operations, including to
17	17	provide grants to local governments and local law enforcement
18	18	agencies to alleviate costs associated with an increased demand on
19	19	local prosecutorial, judicial, and correctional resources, and the
20	20	construction, operation, and maintenance of border barrier
21	21	infrastructure.
22	22	(b) Of the amount appropriated by Subsection (a) of this
23	23	section, the Trusteed Programs within the Office of the Governor
24	24	shall transfer $40,000,000 to the Department of Public Safety for
25	25	border security operations, including paying for additional
26	26	overtime expenses and costs due to an increased law enforcement
27	27	presence to preserve public safety and security in the Colony Ridge
28	28	development in Liberty County, Texas.
29	29	SECTION 2. PROHIBITIONS ON USE OF APPROPRIATED MONEY. The
30	30	money appropriated by this Act may not be used to:
31	31	(1) acquire property through the exercise of eminent
32	32	domain;
33	33	(2) build a barrier along this state's international
34	34	border with Mexico on property acquired through the exercise of
35	35	eminent domain;
36	36	(3) acquire property for a barrier that abuts the
37	37	boundary between this state and another state; or
38	38	(4) build a barrier that abuts the boundary between
39	39	this state and another state.
40	40	SECTION 3. EFFECTIVE DATE. This Act takes effect
41	41	immediately if it receives a vote of two-thirds of all the members
42	42	elected to each house, as provided by Section 39, Article III, Texas
43	43	Constitution. If this Act does not receive the vote necessary for
44	44	immediate effect, this Act takes effect on the 91st day after the
45	45	last day of the legislative session.
