| 9 | 9 | | technology fund in certain municipalities. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article 102.017, Code of Criminal Procedure, is |
|---|
| 12 | 12 | | amended by amending Subsection (a) and adding Subsection (g) to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) The courthouse security fund is a fund in the county |
|---|
| 15 | 15 | | treasury, and, except as provided in Subsection (g), the municipal |
|---|
| 16 | 16 | | court building security fund is a fund in the municipal treasury. |
|---|
| 17 | 17 | | The funds consist of money allocated to the funds under Sections |
|---|
| 18 | 18 | | 134.101, 134.102, 134.103, 135.101, and 135.102, Local Government |
|---|
| 19 | 19 | | Code. |
|---|
| 20 | 20 | | (g) This section does not apply to a municipality with a |
|---|
| 21 | 21 | | population of less than 100,000. |
|---|
| 22 | 22 | | SECTION 2. Article 102.0172, Code of Criminal Procedure, is |
|---|
| 23 | 23 | | amended by amending Subsection (a) and adding Subsection (d) to |
|---|
| 24 | 24 | | read as follows: |
|---|
| 25 | 25 | | (a) Except as provided by Subsection (d), the [The] |

| 27 | 27 | | treasury. The fund consists of money allocated to the fund under |

|---|
| 30 | 30 | | population of less than 100,000. |

| 31 | 31 | | SECTION 3. Subchapter A, Chapter 102, Code of Criminal |
|---|
| 32 | 32 | | Procedure, is amended by adding Article 102.0175 to read as |
|---|
| 33 | 33 | | follows: |
|---|
| 34 | 34 | | Art. 102.0175. CONSOLIDATED MUNICIPAL COURT BUILDING |
|---|
| 35 | 35 | | SECURITY AND TECHNOLOGY FUND. (a) This section applies only to a |
|---|
| 36 | 36 | | municipality with a population of less than 100,000. |
|---|
| 37 | 37 | | (b) The consolidated municipal court building security and |
|---|
| 38 | 38 | | technology fund is a fund in the municipal court treasury. The fund |
|---|
| 39 | 39 | | consists of money allocated to the fund under Section 134.103, |
|---|
| 40 | 40 | | Local Government Code. |
|---|
| 41 | 41 | | (c) Money deposited in a consolidated municipal court |
|---|
| 42 | 42 | | building security and technology fund may be used only for the |
|---|
| 43 | 43 | | purposed authorized under: |
|---|
| 44 | 44 | | (1) Article 102.017(b) or (c) for use of a municipal |
|---|
| 45 | 45 | | court technology fund; or |
|---|
| 46 | 46 | | (2) Article 102.0172(b) for use of a municipal court |
|---|
| 47 | 47 | | technology fund. |
|---|
| 48 | 48 | | (d) The consolidated municipal court building security and |
|---|
| 49 | 49 | | technology fund shall be administered by or under the direction of |
|---|
| 50 | 50 | | the governing body of the municipality. |
|---|
| 51 | 51 | | SECTION 4. Section 134.103(b), Local Government Code, is |
|---|
| 52 | 52 | | amended to read as follows: |
|---|
| 53 | 53 | | (b) The treasurer shall allocate the court costs received |
|---|
| 54 | 54 | | under this section to the following accounts and funds so that each |
|---|
| 55 | 55 | | receives to the extent practicable, utilizing historical data as |
|---|
| 56 | 56 | | applicable, the same amount of money the account or fund would have |
|---|
| 57 | 57 | | received if the court costs for the accounts and funds had been |
|---|
| 58 | 58 | | collected and reported separately, except that the account or fund |
|---|
| 59 | 59 | | may not receive less than the following percentages: |
|---|
| 60 | 60 | | (1) The courthouse security fund, [or] municipal court |
|---|
| 61 | 61 | | building security fund, or consolidated municipal court building |
|---|
| 62 | 62 | | security and technology fund, as appropriate 35 percent; |
|---|
| 63 | 63 | | (2) The local youth diversion fund 35.7143 percent; |
|---|
| 64 | 64 | | (3) The justice court technology fund, [or] municipal |
|---|
| 65 | 65 | | court technology fund, or consolidated municipal court building |
|---|
| 66 | 66 | | security and technology fund, as appropriate 28.5714 percent; and |
|---|
| 67 | 67 | | (4) The county or municipal jury fund, as appropriate |
|---|
| 68 | 68 | | 0.7143 percent. |
|---|
| 69 | 69 | | SECTION 5. The changes in law made by this Act apply only to |
|---|
| 70 | 70 | | a fee on conviction collected on or after the effective date of this |
|---|
| 71 | 71 | | Act. A fee on conviction collected before the effective date of |
|---|
| 72 | 72 | | this Act is governed by the law in effect when the fee was |
|---|
| 73 | 73 | | collected, and the former law is continued in effect for what |
|---|
| 74 | 74 | | purpose. |
|---|
| 75 | 75 | | SECTION 6. This Act takes effect immediately if it receives |
|---|
| 76 | 76 | | two-thirds of all the members elected to each house, as provided by |
|---|
| 77 | 77 | | Section 39, Article III, Texas Constitution. If this Act does not |
|---|
| 78 | 78 | | receive the vote necessary for immediate effect, this Act takes |
|---|
| 79 | 79 | | effect September 1, 2025. |
