77 AN ACT
88 relating to the consolidated municipal court security and
99 technology fund in certain municipalities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 102.017, Code of Criminal Procedure, is
1212 amended by amending Subsection (a) and adding Subsection (g) to
1313 read as follows:
1414 (a) The courthouse security fund is a fund in the county
1515 treasury, and, except as provided in Subsection (g), the municipal
1616 court building security fund is a fund in the municipal treasury.
1717 The funds consist of money allocated to the funds under Sections
1818 134.101, 134.102, 134.103, 135.101, and 135.102, Local Government
1919 Code.
2020 (g) This section does not apply to a municipality with a
2121 population of less than 100,000.
2222 SECTION 2. Article 102.0172, Code of Criminal Procedure, is
2323 amended by amending Subsection (a) and adding Subsection (d) to
2424 read as follows:
2525 (a) Except as provided by Subsection (d), the [The]
2626 municipal court technology fund is a fund in the municipal
2727 treasury. The fund consists of money allocated to the fund under
2828 Section 134.103, Local Government Code.
2929 (d) This section does not apply to a municipality with a
3030 population of less than 100,000.
3131 SECTION 3. Subchapter A, Chapter 102, Code of Criminal
3232 Procedure, is amended by adding Article 102.0175 to read as
3333 follows:
3434 Art. 102.0175. CONSOLIDATED MUNICIPAL COURT BUILDING
3535 SECURITY AND TECHNOLOGY FUND. (a) This section applies only to a
3636 municipality with a population of less than 100,000.
3737 (b) The consolidated municipal court building security and
3838 technology fund is a fund in the municipal court treasury. The fund
3939 consists of money allocated to the fund under Section 134.103,
4040 Local Government Code.
4141 (c) Money deposited in a consolidated municipal court
4242 building security and technology fund may be used only for the
4343 purposed authorized under:
4444 (1) Article 102.017(b) or (c) for use of a municipal
4545 court technology fund; or
4646 (2) Article 102.0172(b) for use of a municipal court
4747 technology fund.
4848 (d) The consolidated municipal court building security and
4949 technology fund shall be administered by or under the direction of
5050 the governing body of the municipality.
5151 SECTION 4. Section 134.103(b), Local Government Code, is
5252 amended to read as follows:
5353 (b) The treasurer shall allocate the court costs received
5454 under this section to the following accounts and funds so that each
5555 receives to the extent practicable, utilizing historical data as
5656 applicable, the same amount of money the account or fund would have
5757 received if the court costs for the accounts and funds had been
5858 collected and reported separately, except that the account or fund
5959 may not receive less than the following percentages:
6060 (1) The courthouse security fund, [or] municipal court
6161 building security fund, or consolidated municipal court building
6262 security and technology fund, as appropriate 35 percent;
6363 (2) The local youth diversion fund 35.7143 percent;
6464 (3) The justice court technology fund, [or] municipal
6565 court technology fund, or consolidated municipal court building
6666 security and technology fund, as appropriate 28.5714 percent; and
6767 (4) The county or municipal jury fund, as appropriate
6868 0.7143 percent.
6969 SECTION 5. The changes in law made by this Act apply only to
7070 a fee on conviction collected on or after the effective date of this
7171 Act. A fee on conviction collected before the effective date of
7272 this Act is governed by the law in effect when the fee was
7373 collected, and the former law is continued in effect for what
7474 purpose.
7575 SECTION 6. This Act takes effect immediately if it receives
7676 two-thirds of all the members elected to each house, as provided by
7777 Section 39, Article III, Texas Constitution. If this Act does not
7878 receive the vote necessary for immediate effect, this Act takes
7979 effect September 1, 2025.
