99 AN ACT
1010 relating to powers and duties of the Texas Workforce Commission
1111 with respect to the procurement of goods and services for the
1212 provision of vocational rehabilitation services.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter B, Chapter 352, Labor Code, is
1515 amended by adding Section 352.060 to read as follows:
1616 Sec. 352.060. PROCUREMENT OF GOODS AND SERVICES. (a) The
1717 commission may enter into contracts for goods or services related
1818 to the commission's provision of vocational rehabilitation
1919 services as necessary to perform any of the commission's powers or
2020 duties under this chapter.
2121 (b) The commission may acquire goods and services described
2222 by Subsection (a) by any procurement method approved by the
2323 commission that provides the best value to the commission. The
2424 commission shall document that the commission considered all
2525 relevant factors under Subsection (c) in making the acquisition.
2626 (c) The commission shall consider all relevant factors in
2727 determining the best value, including:
2828 (1) any installation costs;
2929 (2) the delivery terms;
3030 (3) the quality and reliability of the vendor's goods
3131 or services;
3232 (4) the extent to which the goods or services meet the
3333 needs of the individuals receiving vocational rehabilitation
3434 services from the commission under this chapter;
3535 (5) indicators of probable value vendor performance
3636 under the contract such as past vendor performance, the vendor's
3737 financial resources and ability to perform, the vendor's experience
3838 and responsibility, and the vendor's ability to provide reliable
3939 maintenance agreements;
4040 (6) the impact on the ability of the commission to
4141 comply with laws and rules relating to historically underutilized
4242 businesses or relating to the procurement of goods and services
4343 from persons with disabilities;
4444 (7) the total long-term cost to the commission of
4545 acquiring the vendor's goods or services;
4646 (8) the cost of any employee training associated with
4747 the acquisition;
4848 (9) the effect of an acquisition on commission
4949 productivity;
5050 (10) the acquisition price; and
5151 (11) any other factor relevant to determining the best
5252 value for the commission in the context of a particular
5353 acquisition.
5454 (d) The commission may adopt rules and procedures for the
5555 acquisition of goods and services under this section, including
5656 rules allowing the commission to purchase vocational
5757 rehabilitation services through an open-enrollment contracting
5858 method if the commission determines that the best interests of the
5959 state are served by enrolling multiple vendors.
6060 (e) If the commission does not receive any responsive bids
6161 on an open market solicitation for goods or services for the
6262 vocational rehabilitation program in a specific area of the state,
6363 the commission, after making a written determination that an open
6464 market award is not available, may negotiate with and award the
6565 contract to any qualified vendor who meets the requirements of the
6666 original solicitation:
6767 (1) at a price consistent with the current market
6868 value of the goods or services; and
6969 (2) for a term not to exceed five years.
7070 SECTION 2. The change in law made by this Act applies only
7171 to the acquisition of goods or services made on or after the
7272 effective date of this Act.
7373 SECTION 3. This Act takes effect immediately if it receives
7474 a vote of two-thirds of all the members elected to each house, as
7575 provided by Section 39, Article III, Texas Constitution. If this
7676 Act does not receive the vote necessary for immediate effect, this
7777 Act takes effect September 1, 2025.
