88 AN ACT
99 relating to the authority of a defense base development authority
1010 to employ and commission peace officers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 379B, Local Government Code, is amended
1313 by adding Section 379B.0046 to read as follows:
1414 Sec. 379B.0046. EMPLOYMENT OF AUTHORITY PEACE OFFICERS.
1515 (a) The board may employ and commission peace officers for the
1616 authority to prevent or abate the commission of offenses relating
1717 to port functions, facilities, and operations under state or local
1818 law.
1919 (b) The jurisdiction of a peace officer commissioned under
2020 this section includes the property owned or controlled by the
2121 authority.
2222 (c) In a peace officer's jurisdiction, the peace officer has
2323 the authority granted by Chapter 14, Code of Criminal Procedure.
2424 SECTION 2. Article 2A.001, Code of Criminal Procedure, is
2525 amended to read as follows:
2626 Art. 2A.001. PEACE OFFICERS GENERALLY. The following are
2727 peace officers:
2828 (1) a sheriff, a sheriff's deputy, or a reserve deputy
2929 sheriff who holds a permanent peace officer license issued under
3030 Chapter 1701, Occupations Code;
3131 (2) a constable, a deputy constable, or a reserve
3232 deputy constable who holds a permanent peace officer license issued
3333 under Chapter 1701, Occupations Code;
3434 (3) a marshal or police officer of a municipality or a
3535 reserve municipal police officer who holds a permanent peace
3636 officer license issued under Chapter 1701, Occupations Code;
3737 (4) a ranger, officer, or member of the reserve
3838 officer corps commissioned by the Public Safety Commission and the
3939 director of the Department of Public Safety;
4040 (5) an investigator of a district attorney's, criminal
4141 district attorney's, or county attorney's office;
4242 (6) a law enforcement agent of the Texas Alcoholic
4343 Beverage Commission;
4444 (7) a member of an arson investigating unit
4545 commissioned by a municipality, a county, or the state;
4646 (8) an officer commissioned under Section 37.081,
4747 Education Code, or Subchapter E, Chapter 51, Education Code;
4848 (9) an officer commissioned by the Texas Facilities
4949 Commission;
5050 (10) a law enforcement officer commissioned by the
5151 Parks and Wildlife Commission;
5252 (11) an officer commissioned under Chapter 23,
5353 Transportation Code;
5454 (12) a municipal park and recreational patrol officer
5555 or security officer;
5656 (13) a security officer or investigator commissioned
5757 as a peace officer by the comptroller;
5858 (14) an officer commissioned by a water control and
5959 improvement district under Section 49.216, Water Code;
6060 (15) an officer commissioned by a board of trustees
6161 under Chapter 54, Transportation Code;
6262 (16) an investigator commissioned by the Texas Medical
6363 Board;
6464 (17) an officer commissioned by:
6565 (A) the board of managers of the Dallas County
6666 Hospital District, the Tarrant County Hospital District, the Bexar
6767 County Hospital District, or the El Paso County Hospital District
6868 under Section 281.057, Health and Safety Code;
6969 (B) the board of directors of the Ector County
7070 Hospital District under Section 1024.117, Special District Local
7171 Laws Code;
7272 (C) the board of directors of the Midland County
7373 Hospital District of Midland County, Texas, under Section 1061.121,
7474 Special District Local Laws Code; [or]
7575 (D) the board of hospital managers of the Lubbock
7676 County Hospital District of Lubbock County, Texas, under Section
7777 1053.113, Special District Local Laws Code; or
7878 (E) the board of directors of a defense base
7979 development authority established under Chapter 379B, Local
8080 Government Code;
8181 (18) a county park ranger commissioned under
8282 Subchapter E, Chapter 351, Local Government Code;
8383 (19) an investigator employed by the Texas Racing
8484 Commission;
8585 (20) an officer commissioned under Chapter 554,
8686 Occupations Code;
8787 (21) an officer commissioned by the governing body of
8888 a metropolitan rapid transit authority under Section 451.108,
8989 Transportation Code, or a regional transportation authority under
9090 Section 452.110, Transportation Code;
9191 (22) an investigator commissioned by the attorney
9292 general under Section 402.009, Government Code;
9393 (23) a security officer or investigator commissioned
9494 as a peace officer under Chapter 466, Government Code;
9595 (24) an officer appointed by an appellate court under
9696 Subchapter F, Chapter 53, Government Code;
9797 (25) an officer commissioned by the state fire marshal
9898 under Chapter 417, Government Code;
9999 (26) an investigator commissioned by the commissioner
100100 of insurance under Section 701.104, Insurance Code;
101101 (27) an apprehension specialist or inspector general
102102 commissioned by the Texas Juvenile Justice Department as an officer
103103 under Section 242.102 or 243.052, Human Resources Code;
104104 (28) an officer appointed by the inspector general of
105105 the Texas Department of Criminal Justice under Section 493.019,
106106 Government Code;
107107 (29) an investigator commissioned by the Texas
108108 Commission on Law Enforcement under Section 1701.160, Occupations
109109 Code;
110110 (30) a fire marshal or any related officer, inspector,
111111 or investigator commissioned by a county under Subchapter B,
112112 Chapter 352, Local Government Code;
113113 (31) a fire marshal or any officer, inspector, or
114114 investigator commissioned by an emergency services district under
115115 Chapter 775, Health and Safety Code;
116116 (32) an officer commissioned by the State Board of
117117 Dental Examiners under Section 254.013, Occupations Code, subject
118118 to the limitations imposed by that section; and
119119 (33) an investigator commissioned by the Texas
120120 Juvenile Justice Department as an officer under Section 221.011,
121121 Human Resources Code.
122122 SECTION 3. To the extent of any conflict, this Act prevails
123123 over another Act of the 89th Legislature, Regular Session, 2025,
124124 relating to nonsubstantive additions to and corrections in enacted
125125 codes.
126126 SECTION 4. This Act takes effect September 1, 2025.
