| 8 | 8 | | relating to the confidentiality of certain personal information in |

| 9 | 9 | | the custody of certain law enforcement and health care agencies of |
|---|
| 10 | 10 | | this state. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 552, Government Code, is |
|---|
| 13 | 13 | | amended by adding Section 552.164 to read as follows: |
|---|
| 14 | 14 | | Sec. 552.164. EXCEPTION: CONFIDENTIALITY OF CERTAIN |
|---|
| 15 | 15 | | INFORMATION SUBMITTED TO STATE LAW ENFORCEMENT AND HEALTH CARE |
|---|
| 16 | 16 | | AGENCIES. (a) This section applies only to the following |
|---|
| 17 | 17 | | governmental bodies: |
|---|
| 18 | 18 | | (1) the Department of Public Safety; |
|---|
| 19 | 19 | | (2) the Department of State Health Services; and |
|---|
| 20 | 20 | | (3) the Health and Human Services Commission. |
|---|
| 21 | 21 | | (b) The following information in the custody of a |
|---|
| 22 | 22 | | governmental body described by Subsection (a)(1) is confidential if |
|---|
| 23 | 23 | | a person provided the information to the governmental body for |
|---|
| 24 | 24 | | purposes of obtaining or updating the information appearing on a |
|---|
| 25 | 25 | | state driver's license, state identification card, or license to |
|---|
| 26 | 26 | | carry a handgun: |
|---|
| 27 | 27 | | (1) sex; |
|---|
| 28 | 28 | | (2) date of birth; and |
|---|
| 29 | 29 | | (3) home address. |
|---|
| 30 | 30 | | (c) The following information in the custody of a |
|---|
| 31 | 31 | | governmental body described by Subsection (a)(2) or (3) is |
|---|
| 32 | 32 | | confidential if an individual provided the information to the |
|---|
| 33 | 33 | | governmental body for purposes of obtaining or establishing |
|---|
| 34 | 34 | | eligibility for health care services: |
|---|
| 35 | 35 | | (1) health-related information; |
|---|
| 36 | 36 | | (2) sex; |
|---|
| 37 | 37 | | (3) date of birth; and |
|---|
| 38 | 38 | | (4) home address. |
|---|
| 39 | 39 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 40 | 40 | | to a request for information that is received by a governmental body |
|---|
| 41 | 41 | | on or after the effective date of this Act. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2025. |
