66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the confidentiality of certain personal information in
99 the custody of certain law enforcement and health care agencies of
1010 this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1313 amended by adding Section 552.164 to read as follows:
1414 Sec. 552.164. EXCEPTION: CONFIDENTIALITY OF CERTAIN
1515 INFORMATION SUBMITTED TO STATE LAW ENFORCEMENT AND HEALTH CARE
1616 AGENCIES. (a) This section applies only to the following
1717 governmental bodies:
1818 (1) the Department of Public Safety;
1919 (2) the Department of State Health Services; and
2020 (3) the Health and Human Services Commission.
2121 (b) The following information in the custody of a
2222 governmental body described by Subsection (a)(1) is confidential if
2323 a person provided the information to the governmental body for
2424 purposes of obtaining or updating the information appearing on a
2525 state driver's license, state identification card, or license to
2626 carry a handgun:
2727 (1) sex;
2828 (2) date of birth; and
2929 (3) home address.
3030 (c) The following information in the custody of a
3131 governmental body described by Subsection (a)(2) or (3) is
3232 confidential if an individual provided the information to the
3333 governmental body for purposes of obtaining or establishing
3434 eligibility for health care services:
3535 (1) health-related information;
3636 (2) sex;
3737 (3) date of birth; and
3838 (4) home address.
3939 SECTION 2. The change in law made by this Act applies only
4040 to a request for information that is received by a governmental body
4141 on or after the effective date of this Act.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
