By: Rosenthal H.B. No. 4484 A BILL TO BE ENTITLED AN ACT relating to the confidentiality of certain personal information in the custody of certain law enforcement and health care agencies of this state. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 552, Government Code, is amended by adding Section 552.164 to read as follows: Sec. 552.164. EXCEPTION: CONFIDENTIALITY OF CERTAIN INFORMATION SUBMITTED TO STATE LAW ENFORCEMENT AND HEALTH CARE AGENCIES. (a) This section applies only to the following governmental bodies: (1) the Department of Public Safety; (2) the Department of State Health Services; and (3) the Health and Human Services Commission. (b) The following information in the custody of a governmental body described by Subsection (a)(1) is confidential if a person provided the information to the governmental body for purposes of obtaining or updating the information appearing on a state driver's license, state identification card, or license to carry a handgun: (1) sex; (2) date of birth; and (3) home address. (c) The following information in the custody of a governmental body described by Subsection (a)(2) or (3) is confidential if an individual provided the information to the governmental body for purposes of obtaining or establishing eligibility for health care services: (1) health-related information; (2) sex; (3) date of birth; and (4) home address. SECTION 2. The change in law made by this Act applies only to a request for information that is received by a governmental body on or after the effective date of this Act. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
