810 AN ACT
911 relating to an exemption from jury service for certain crime
1012 victims or close relatives of deceased crime victims.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Section 62.106(a), Government Code, is amended
1315 to read as follows:
1416 (a) A person qualified to serve as a petit juror may
1517 establish an exemption from jury service if the person:
1618 (1) is over 75 years of age;
1719 (2) has legal custody of a child younger than 12 years
1820 of age and the person's service on the jury requires leaving the
1921 child without adequate supervision;
2022 (3) is a student of a public or private secondary
2123 school;
2224 (4) is a person enrolled and in actual attendance at an
2325 institution of higher education;
2426 (5) is an officer or an employee of the senate, the
2527 house of representatives, or any department, commission, board,
2628 office, or other agency in the legislative branch of state
2729 government;
2830 (6) is summoned for service in a county with a
2931 population of at least 200,000, unless that county uses a jury plan
3032 under Section 62.011 and the period authorized under Section
3133 62.011(b)(5) exceeds two years, and the person has served as a petit
3234 juror in the county during the 24-month period preceding the date
3335 the person is to appear for jury service;
3436 (7) is the primary caretaker of a person who is unable
3537 to care for himself or herself;
3638 (8) except as provided by Subsection (b), is summoned
3739 for service in a county with a population of at least 250,000 and
3840 the person has served as a petit juror in the county during the
3941 three-year period preceding the date the person is to appear for
4042 jury service; [or]
4143 (9) is a member of the United States military forces
4244 serving on active duty and deployed to a location away from the
4345 person's home station and out of the person's county of residence;
4446 or
4547 (10) is a victim or close relative of a deceased victim
4648 of a crime, as those terms are defined by Article 56A.001, Code of
4749 Criminal Procedure, who:
4850 (A) testified in a court proceeding relating to
4951 the offense of which the person or the person's deceased close
5052 relative was a victim; and
5153 (B) would suffer severe anxiety or
5254 post-traumatic stress as a result of attending a court proceeding.
5355 SECTION 2. The change in law made by this Act applies only
5456 to an exemption from jury service for a person who is summoned to
5557 appear for service on or after the effective date of this Act. An
5658 exemption from jury service for a person who is summoned to appear
5759 for service before the effective date of this Act is covered by the
5860 law in effect when the person was summoned, and that law is
5961 continued in effect for that purpose.
6062 SECTION 3. This Act takes effect September 1, 2025.
