10 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 13 | | SECTION 1. Subchapter D, Chapter 551, Government Code, is |
---|
12 | 14 | | amended by adding Section 551.092 to read as follows: |
---|
13 | 15 | | Sec. 551.092. STATE GOVERNMENTAL BODIES: DEFENSE, |
---|
14 | 16 | | MILITARY, AND AEROSPACE ISSUES; CLOSED MEETING. (a) In this |
---|
15 | 17 | | section, "defense, military, or aerospace issue" means a matter |
---|
16 | 18 | | related to: |
---|
17 | 19 | | (1) the establishment of an office, base, or major |
---|
18 | 20 | | facility in this state by the United States Department of Defense or |
---|
19 | 21 | | the National Aeronautics and Space Administration; or |
---|
20 | 22 | | (2) an economic incentive a governmental body may |
---|
21 | 23 | | offer to a private entity or nonprofit organization to meet a match |
---|
22 | 24 | | requirement or other requirement established by the United States |
---|
23 | 25 | | Department of Defense or the National Aeronautics and Space |
---|
24 | 26 | | Administration in relation to grants or strategic endeavors. |
---|
25 | 27 | | (b) The governing board of a governmental body described by |
---|
26 | 28 | | Section 551.001(3)(A) may conduct a closed meeting to deliberate a |
---|
27 | 29 | | defense, military, or aerospace issue. |
---|
28 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
---|
29 | 31 | | a vote of two-thirds of all the members elected to each house, as |
---|
30 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
31 | 33 | | Act does not receive the vote necessary for immediate effect, this |
---|
32 | 34 | | Act takes effect September 1, 2025. |
