68 AN ACT
79 relating to the authority of the governing board of a state
810 governmental body to conduct a closed meeting to deliberate an
911 issue involving certain defense, military, or aerospace issues.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Subchapter D, Chapter 551, Government Code, is
1214 amended by adding Section 551.092 to read as follows:
1315 Sec. 551.092. STATE GOVERNMENTAL BODIES: DEFENSE,
1416 MILITARY, AND AEROSPACE ISSUES; CLOSED MEETING. (a) In this
1517 section, "defense, military, or aerospace issue" means a matter
1618 related to:
1719 (1) the establishment of an office, base, or major
1820 facility in this state by the United States Department of Defense or
1921 the National Aeronautics and Space Administration; or
2022 (2) an economic incentive a governmental body may
2123 offer to a private entity or nonprofit organization to meet a match
2224 requirement or other requirement established by the United States
2325 Department of Defense or the National Aeronautics and Space
2426 Administration in relation to grants or strategic endeavors.
2527 (b) The governing board of a governmental body described by
2628 Section 551.001(3)(A) may conduct a closed meeting to deliberate a
2729 defense, military, or aerospace issue.
2830 SECTION 2. This Act takes effect immediately if it receives
2931 a vote of two-thirds of all the members elected to each house, as
3032 provided by Section 39, Article III, Texas Constitution. If this
3133 Act does not receive the vote necessary for immediate effect, this
3234 Act takes effect September 1, 2025.
