| 11 | 18 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 19 | | SECTION 1. Subchapter Z, Chapter 2252, Government Code, is |
|---|
| 13 | 20 | | amended by adding Section 2252.902 to read as follows: |
|---|
| 14 | 21 | | Sec. 2252.902. CONTRACTS WITH NONPROFIT ORGANIZATIONS. (a) |
|---|
| 15 | 22 | | In this section: |
|---|
| 16 | 23 | | (1) "Economic development corporation" means: |
|---|
| 17 | 24 | | (A) a Type A corporation governed by Chapter 504, |
|---|
| 18 | 25 | | Local Government Code; and |
|---|
| 19 | 26 | | (B) a Type B corporation governed by Chapter 505 |
|---|
| 20 | 27 | | of that code. |
|---|
| 21 | 28 | | (2) "Nonprofit organization" means an organization |
|---|
| 22 | 29 | | that is exempt from federal income tax under Section 501(a), |
|---|
| 23 | 30 | | Internal Revenue Code of 1986, by being listed as an exempt |
|---|
| 24 | 31 | | organization in Section 501(c) of that code. The term includes an |
|---|
| 25 | 32 | | economic development corporation. |
|---|
| 26 | 33 | | (3) "Political subdivision" means a county, |
|---|
| 27 | 34 | | municipality, or economic development corporation. |
|---|
| 28 | 35 | | (4) "State agency" means a department, commission, |
|---|
| 29 | 36 | | board, office, or other entity in the executive, legislative, or |
|---|
| 30 | 37 | | judicial branch of state government. The term does not include an |
|---|
| 31 | 38 | | institution of higher education or a university system as defined |
|---|
| 32 | 39 | | by Section 61.003, Education Code. |
|---|
| 33 | 40 | | (b) This section applies only to a contract between a |
|---|
| 34 | 41 | | nonprofit organization and a political subdivision that has an |
|---|
| 35 | 42 | | annual value of more than $500,000. |
|---|
| 36 | 43 | | (c) This section does not apply to a nonprofit organization |
|---|
| 37 | 44 | | that is: |
|---|
| 38 | 45 | | (1) an electric cooperative as defined by Section |
|---|
| 39 | 46 | | 11.003, Utilities Code; |
|---|
| 40 | 47 | | (2) an organization certified as an independent |
|---|
| 41 | 48 | | organization under Section 39.151, Utilities Code; or |
|---|
| 42 | 49 | | (3) a water supply corporation created and operating |
|---|
| 43 | 50 | | under Chapter 67, Water Code. |
|---|
| 44 | 51 | | (d) A nonprofit organization that enters into a contract |
|---|
| 45 | 52 | | with a political subdivision shall provide the following |
|---|
| 46 | 53 | | information to the political subdivision when the contract is |
|---|
| 47 | 54 | | entered into, and shall update the information not later than the |
|---|
| 48 | 55 | | 30th day of each fiscal year of the organization until the contract |
|---|
| 49 | 56 | | expires: |
|---|
| 50 | 57 | | (1) the organization's operating budget for the |
|---|
| 51 | 58 | | current fiscal year; and |
|---|
| 52 | 59 | | (2) the salary of each employee of the organization |
|---|
| 53 | 60 | | that exceeds 200 percent of the median salary of state employees. |
|---|
| 54 | 61 | | (e) A political subdivision that maintains an Internet |
|---|
| 55 | 62 | | website shall publish and maintain the information received under |
|---|
| 56 | 63 | | Subsection (d) on the website. |
|---|
| 57 | 64 | | (f) For the purposes of this section, the comptroller shall |
|---|
| 58 | 65 | | determine the median salary paid each state fiscal year from the |
|---|
| 59 | 66 | | state treasury to employees of a state agency. The comptroller's |
|---|
| 60 | 67 | | determination must be published on the comptroller's Internet |
|---|
| 61 | 68 | | website not later than October 1 of each year. |
|---|
| 62 | 69 | | (g) The attorney general may bring an action for injunctive |
|---|
| 63 | 70 | | relief against a political subdivision or an officer or employee of |
|---|
| 64 | 71 | | a political subdivision to enforce this section. |
|---|
| 65 | 72 | | SECTION 2. Section 2252.902, Government Code, as added by |
|---|
| 66 | 73 | | this Act, applies only to a contract entered into on or after the |
|---|
| 67 | 74 | | effective date of this Act. |
|---|
| 68 | 75 | | SECTION 3. This Act takes effect September 1, 2025. |
