613 A BILL TO BE ENTITLED
714 AN ACT
815 relating to the disclosure of certain financial information by
916 certain nonprofit organizations that enter into sizeable contracts
1017 with political subdivisions.
1118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1219 SECTION 1. Subchapter Z, Chapter 2252, Government Code, is
1320 amended by adding Section 2252.902 to read as follows:
1421 Sec. 2252.902. CONTRACTS WITH NONPROFIT ORGANIZATIONS. (a)
1522 In this section:
1623 (1) "Economic development corporation" means:
1724 (A) a Type A corporation governed by Chapter 504,
1825 Local Government Code; and
1926 (B) a Type B corporation governed by Chapter 505
2027 of that code.
2128 (2) "Nonprofit organization" means an organization
2229 that is exempt from federal income tax under Section 501(a),
2330 Internal Revenue Code of 1986, by being listed as an exempt
2431 organization in Section 501(c) of that code. The term includes an
2532 economic development corporation.
2633 (3) "Political subdivision" means a county,
2734 municipality, or economic development corporation.
2835 (4) "State agency" means a department, commission,
2936 board, office, or other entity in the executive, legislative, or
3037 judicial branch of state government. The term does not include an
3138 institution of higher education or a university system as defined
3239 by Section 61.003, Education Code.
3340 (b) This section applies only to a contract between a
3441 nonprofit organization and a political subdivision that has an
3542 annual value of more than $500,000.
3643 (c) This section does not apply to a nonprofit organization
3744 that is:
3845 (1) an electric cooperative as defined by Section
3946 11.003, Utilities Code;
4047 (2) an organization certified as an independent
4148 organization under Section 39.151, Utilities Code; or
4249 (3) a water supply corporation created and operating
4350 under Chapter 67, Water Code.
4451 (d) A nonprofit organization that enters into a contract
4552 with a political subdivision shall provide the following
4653 information to the political subdivision when the contract is
4754 entered into, and shall update the information not later than the
4855 30th day of each fiscal year of the organization until the contract
4956 expires:
5057 (1) the organization's operating budget for the
5158 current fiscal year; and
5259 (2) the salary of each employee of the organization
5360 that exceeds 200 percent of the median salary of state employees.
5461 (e) A political subdivision that maintains an Internet
5562 website shall publish and maintain the information received under
5663 Subsection (d) on the website.
5764 (f) For the purposes of this section, the comptroller shall
5865 determine the median salary paid each state fiscal year from the
5966 state treasury to employees of a state agency. The comptroller's
6067 determination must be published on the comptroller's Internet
6168 website not later than October 1 of each year.
6269 (g) The attorney general may bring an action for injunctive
6370 relief against a political subdivision or an officer or employee of
6471 a political subdivision to enforce this section.
6572 SECTION 2. Section 2252.902, Government Code, as added by
6673 this Act, applies only to a contract entered into on or after the
6774 effective date of this Act.
6875 SECTION 3. This Act takes effect September 1, 2025.
