613 A BILL TO BE ENTITLED
714 AN ACT
815 relating to the administration of a grant program to support
916 community mental health programs assisting veterans and their
1017 families.
1118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1219 SECTION 1. Sections 547.0304 and 547.0305, Government Code,
1320 as effective April 1, 2025, are amended to read as follows:
1421 Sec. 547.0304. MATCHING GRANT CONDITIONS: SINGLE COUNTIES.
1522 For services and treatment provided in a single county, the
1623 commission shall condition each grant provided under this
1724 subchapter on a potential grant recipient providing funds from
1825 non-state sources in a total amount at least equal to:
1926 (1) 25 percent of the grant amount if the community
2027 mental health program to be supported by the grant provides
2128 services and treatment in a county with a population of less than
2229 100,000;
2330 (2) 50 percent of the grant amount if the community
2431 mental health program to be supported by the grant provides
2532 services and treatment in a county with a population of 100,000 or
2633 more but less than 250,000; or
2734 (3) 75 [100] percent of the grant amount if the
2835 community mental health program to be supported by the grant
2936 provides services and treatment in a county with a population of
3037 250,000 or more.
3138 Sec. 547.0305. MATCHING GRANT CONDITIONS: MULTIPLE
3239 COUNTIES. For a community mental health program that provides
3340 services and treatment in more than one county, the commission
3441 shall condition each grant provided under this subchapter on a
3542 potential grant recipient providing funds from non-state sources in
3643 a total amount at least equal to:
3744 (1) 25 percent of the grant amount if the county with
3845 the largest population in which the community mental health program
3946 to be supported by the grant provides services and treatment has a
4047 population of less than 100,000;
4148 (2) 50 percent of the grant amount if the county with
4249 the largest population in which the community mental health program
4350 to be supported by the grant provides services and treatment has a
4451 population of 100,000 or more but less than 250,000; or
4552 (3) 75 [100] percent of the grant amount if the county
4653 with the largest population in which the community mental health
4754 program to be supported by the grant provides services and
4855 treatment has a population of 250,000 or more.
4956 SECTION 2. The changes in law made by this Act apply only to
5057 a grant awarded on or after the effective date of this Act. A grant
5158 awarded before the effective date of this Act is governed by the law
5259 in effect on the date the award was made, and the former law is
5360 continued in effect for that purpose.
5461 SECTION 3. The Health and Human Services Commission is
5562 required to implement the changes in law made by this Act to
5663 Sections 547.0304 and 547.0305, Government Code, only if the
5764 legislature appropriates money specifically for that purpose in an
5865 amount greater than the amount appropriated to the commission for
5966 that purpose for the state fiscal biennium ending August 31, 2025.
6067 If the legislature does not appropriate money specifically for that
6168 purpose and in such amount, the commission may, but is not required
6269 to, implement those changes in law using other money available to
6370 the commission for that purpose.
6471 SECTION 4. This Act takes effect September 1, 2025.
