15+(a) A
16+MENDATORYDEFINITIONS.— 5

18+N GENERAL.—Section 3304 of title 5, 6
19+United States Code, is amended— 7
20+(A) by redesignating subsections (b) 8
21+through (g) as subsections (h) through (m), re-9
22+spectively; 10
23+(B) by redesignating subsection (a) as sub-11

53+score’ means a minimum acceptable score or rating, 7
54+consistent with applicable law, that may include a 8
55+quantitative or qualitative assessment that an appli-9
56+cant can pass or fail. 10

58+ELEVANT COMMITTEES .—The term ‘rel-11
59+evant committees’ means— 12
60+‘‘(A) the Committee on Homeland Security 13
61+and Governmental Affairs of the Senate; and 14
62+‘‘(B) the Committee on Oversight and Ac-15
63+countability of the House of Representatives. 16

65+UBJECT MATTER EXPERT .—The term 17
66+‘subject matter expert’ means an employee or select-18
67+ing official— 19
68+‘‘(A) who possesses an understanding of 20
69+the duties of, and knowledge, skills, and abili-21
70+ties required for, the position for which the em-22
71+ployee or selecting official is developing or ad-23
72+ministering an examination; and 24 4

74+‘‘(B) whom the delegated examining unit 1
75+of the examining agency that employs the em-2
76+ployee or selecting official designates to assist 3
77+in the development and administration of tech-4
78+nical assessments. 5

80+ECHNICAL ASSESSMENT .—The term 6
81+‘technical assessment’ means a position-specific tool 7
82+that is relevant to the position for which the tool is 8
83+developed that— 9
84+‘‘(A) allows for the demonstration of job- 10
85+related skills, abilities, knowledge, and com-11
86+petencies; 12
87+‘‘(B) is based upon a job analysis; and 13
88+‘‘(C) does not solely include or principally 14
89+rely upon a self-assessment from an automated 15
90+examination.’’. 16

172+SEC. 3. MODERNIZING FEDERAL HIRING. 8
173+Section 3304 of title 5, United States Code, is 9
174+amended by inserting after subsection (b), as redesignated 10
175+by section 2, the following: 11

177+XAMINATIONS.— 12
178+‘‘(1) I
179+N GENERAL.—For the purpose of testing 13
180+applicants for appointment for a position, or class of 14
181+positions, in the competitive service, an examining 15
182+agency shall conduct an examination pursuant to 16
183+subsection (b). 17

185+NTERIM EXAMINATION PERIOD .— 18
186+‘‘(A) P
187+REFERENCE FOR TECHNICAL AS -19
188+SESSMENT.—During the 3-year period begin-20
189+ning on the date of enactment of the Chance to 21
190+Compete Act of 2024, an examining agency 22
191+shall preference the use of a technical assess-23
192+ment, to the maximum extent practicable, to as-24
193+sess the job-related skills, abilities, knowledge, 25 8
194+†S 59 ES
195+and competencies of an applicant for a position 1
196+in the competitive service. 2
197+‘‘(B) U
198+SE OF ALTERNATIVE ASSESS -3
199+MENT.—During the 3-year period beginning on 4
200+the date of enactment of the Chance to Com-5
201+pete Act of 2024, if an examining agency deter-6
202+mines that the use of a technical assessment to 7
203+assess the job-related skills, abilities, knowl-8
204+edge, and competencies of an applicant for a 9
205+position in the competitive service is not prac-10
206+ticable, the examining agency may use an alter-11
207+native assessment for that purpose if the exam-12
208+ining agency includes a brief description of the 13
209+rationale for the use of the alternative assess-14
210+ment in the job posting. 15
211+‘‘(3) T
212+RANSITION PLANNING.— 16
213+‘‘(A) I
214+N GENERAL.—Not later 18 months 17
215+after the date of enactment of the Chance to 18
216+Compete Act of 2024, the Director shall submit 19
217+to the relevant committees a plan to transition 20
218+Federal hiring practices to adopt technical as-21
219+sessments in accordance with subsection (d), 22
220+which shall include— 23
221+‘‘(i) the prioritization of— 24
222+‘‘(I) job classifications; and 25 9
223+†S 59 ES
224+‘‘(II) resource requirements; and 1
225+‘‘(ii) a timeline for full implementa-2
226+tion of the transition. 3
227+‘‘(B) A
228+DDITIONAL CONSULTATION .—In de-4
229+veloping the plan under subparagraph (A), the 5
230+Director shall consult with, at minimum— 6
231+‘‘(i) the Director of the Office of Man-7
232+agement and Budget; 8
233+‘‘(ii) the Chair of the Chief Human 9
234+Capital Officers Council; 10
235+‘‘(iii) employee representatives; and 11
236+‘‘(iv) relevant external stakeholders. 12
237+‘‘(4) I
238+MPLEMENTATION OF TECHNICAL ASSESS -13
239+MENTS.— 14
240+‘‘(A) I
241+MPLEMENTATION OF PLAN .—Not 15
242+later than 3 years after the date of enactment 16
243+of the Chance to Compete Act of 2024, the Di-17
244+rector shall implement the plan submitted 18
245+under paragraph (3). 19
246+‘‘(B) A
247+DOPTION OF TECHNICAL ASSESS -20
248+MENTS.—On and after the date that is 3 years 21
249+after the date of enactment of the Chance to 22
250+Compete Act of 2024, an examining agency 23
251+shall use a technical assessment to examine ap-24 10
252+†S 59 ES
253+plicants for positions in the competitive service 1
254+in accordance with subsection (d). 2
255+‘‘(C) W
256+AIVER.— 3
257+‘‘(i) I
258+N GENERAL.—The requirement 4
259+under subparagraph (B) shall not apply to 5
260+an examining agency with respect to a par-6
261+ticular job series if— 7
262+‘‘(I) the examining agency deter-8
263+mines that use of a technical assess-9
264+ment is impracticable for the job se-10
265+ries; and 11
266+‘‘(II) the head of the examining 12
267+agency submits to the Director and 13
268+the relevant committees a certification 14
269+that use of the technical assessment is 15
270+impracticable, which certification shall 16
271+include— 17
272+‘‘(aa) identification of the 18
273+job series; 19
274+‘‘(bb) identification of the 20
275+number of positions that are in-21
276+cluded in the job series within 22
277+the agency for which the exam-23
278+ining agency is conducting exami-24
279+nations; and 25 11

281+‘‘(cc) a description of the ra-1
282+tionale for the determination. 2
283+‘‘(ii) E
284+FFECTIVENESS OF WAIVER .—A 3
285+waiver under this subparagraph shall be 4
286+effective for the period— 5
287+‘‘(I) beginning on the date that is 6
288+1 day after the date on which the ap-7
289+plicable certification is submitted 8
290+under clause (i)(II); and 9
291+‘‘(II) ending on the date that is 10
292+3 years after the date on which the 11
293+applicable certification is submitted 12
294+under clause (i)(II). 13
295+‘‘(iii) N
296+O DELEGATION OF CERTIFI -14
297+CATION AUTHORITY.—The head of an ex-15
298+amining agency may not delegate the au-16
299+thority to submit a certification under 17
300+clause (i)(II). 18
301+‘‘(d) T
302+ECHNICALASSESSMENT.— 19
303+‘‘(1) I
304+N GENERAL.—For the purpose of con-20
305+ducting an examination for a position in the com-21
306+petitive service, an individual who is determined by 22
307+an examining agency to be a subject matter expert 23
308+in the subject and job field of the position may— 24 12
309+†S 59 ES
310+‘‘(A) develop, in partnership with human 1
311+resources employees of the examining agency, a 2
312+position-specific assessment that is relevant to 3
313+the position, based on job analysis, which may 4
314+include— 5
315+‘‘(i) a structured interview; 6
316+‘‘(ii) a work-related exercise; 7
317+‘‘(iii) a custom or generic procedure 8
318+used to measure an applicant’s employ-9
319+ment or career-related qualifications and 10
320+interests; or 11
321+‘‘(iv) another assessment that— 12
322+‘‘(I) allows for the demonstration 13
323+of job-related technical skills, abilities, 14
324+and knowledge; and 15
325+‘‘(II) is relevant to the position 16
326+for which the assessment is developed; 17
327+and 18
328+‘‘(B) administer the assessment developed 19
329+under subparagraph (A) to— 20
330+‘‘(i) determine whether an applicant 21
331+for the position has a passing score to be 22
332+qualified for the position; or 23 13

334+‘‘(ii) rank applicants for the position 1
335+for category rating purposes under section 2

337+‘‘(2) F
338+EASIBILITY STUDY ON SHARING AND 4
339+CUSTOMIZATION OF ASSESSMENT .—Not later than 1 5
340+year after the date of enactment of the Chance to 6
341+Compete Act of 2024, the Director shall— 7
342+‘‘(A) conduct a feasibility study that exam-8
343+ines the practicability, including a cost benefit 9
344+analysis, of— 10
345+‘‘(i) the sharing of technical assess-11
346+ments by an examining agency with an-12
347+other examining agency; 13
348+‘‘(ii) mechanisms for each examining 14
349+agency to maintain appropriate control 15
350+over examination material that is shared 16
351+by the examining agency as described in 17
352+clause (i); 18
353+‘‘(iii) limits on customization of a 19
354+technical assessment that is shared as de-20
355+scribed in clause (i) and mechanisms to en-21
356+sure that the resulting technical assess-22
357+ment satisfies the requirements under part 23
358+300 of title 5, Code of Federal Regulations 24
359+(or any successor regulation); and 25 14

361+‘‘(iv) the development of an online 1
362+platform on which examining agencies can 2
363+share and customize technical assessments 3
364+as described in this subparagraph; and 4
365+‘‘(B) submit to the relevant committees a 5
366+report on the study conducted under subpara-6
367+graph (A). 7
368+‘‘(e) F
369+EDERALAGENCYTALENTTEAMS.— 8
370+‘‘(1) I
371+N GENERAL.—An agency may establish 1 9
372+or more agency talent teams, including at the com-10
373+ponent level. 11
374+‘‘(2) D
375+UTIES.—An agency talent team shall 12
376+provide hiring support to the agency, including by— 13
377+‘‘(A) improving examinations; 14
378+‘‘(B) facilitating the writing of job an-15
379+nouncements for the competitive service; 16
380+‘‘(C) sharing high-quality certificates of eli-17
381+gible applicants; and 18
382+‘‘(D) facilitating hiring for the competitive 19
383+service using examinations. 20
384+‘‘(f) O
385+FFICE OFPERSONNELMANAGEMENTTALENT 21

387+EAM.—The Director may establish a Federal talent team 22
388+to support agency talent teams by— 23
389+‘‘(1) facilitating hiring actions across the Fed-24
390+eral Government; 25 15

392+‘‘(2) providing training; 1
393+‘‘(3) creating tools and guides to facilitate hir-2
394+ing for the competitive service; and 3
395+‘‘(4) developing technical assessments. 4
396+‘‘(g) R
397+ULEMAKING.—The Director shall promulgate 5
398+such regulations as are necessary to implement and inter-6
399+pret this section.’’. 7
400+SEC. 4. COMPETITIVE SERVICE CANDIDATE HIRING AND 8
401+REFORM. 9
402+(a) R
403+EVIEW.— 10
404+(1) I
405+N GENERAL.—The Director shall conduct a 11
406+review of examinations for hiring for each position 12
407+in the competitive service that an examining agency 13
408+has determined requires a minimum educational re-14
409+quirement because the position is of a scientific, 15
410+technical, or professional nature pursuant to section 16
411+3308 of title 5, United States Code, to determine 17
412+whether data, evidence, or other information justifies 18
413+the need for educational requirements for the posi-19
414+tion. 20
415+(2) C
416+ONSULTATION.—In carrying out para-21
417+graph (1), the Director shall consult with, at min-22
418+imum— 23
419+(A) agencies, as deemed appropriate by the 24
420+Director; 25 16

422+(B) employee representatives; 1
423+(C) external experts; and 2
424+(D) relevant stakeholders. 3
425+(b) R
426+EPORT ONHIRINGPRACTICES.—Not later than 4
427+1 year after the date of enactment of this Act, the Director 5
428+shall submit to the relevant committees recommendations 6
429+to amend the hiring practices of examining agencies in ac-7
430+cordance with the findings of the review conducted under 8
431+subsection (a)(1). 9
432+SEC. 5. REPORTS. 10
433+(a) I
434+MPLEMENTATION REPORTS.— 11
435+(1) I
436+N GENERAL.—Not later than 1 year after 12
437+the date of enactment of this Act, and each year 13
438+thereafter ending with the fifth publication and sub-14
439+mission of the report, the Director shall publish on 15
440+a public-facing website, and submit to the relevant 16
441+committees, a report that— 17
442+(A) examines the progress of examining 18
443+agencies in implementing the requirements of 19
444+this Act and the amendments made by this Act; 20
445+and 21
446+(B) identifies any significant difficulties 22
447+encountered in the implementation described in 23
448+subparagraph (A). 24 17

450+(2) INCLUSION IN ANNUAL REPORT .—The Di-1
451+rector may include the report required under para-2
452+graph (1) as an addendum to the report required 3
453+under subsection (b). 4

455+ELAYED REPORTING .—If the Director is 5
456+unable to publish and submit the report within the 6
457+timeline required under paragraph (1), the Director 7
458+shall publish on a public-facing website, and submit 8
459+to the relevant committees, a notification of the 9
460+delay that— 10
461+(A) provides a reason for the delay; and 11
462+(B) advises the public and the relevant 12
463+committees of the anticipated date of publica-13
464+tion and submission of the report. 14

466+NNUALREPORT.— 15
467+(1) I
468+N GENERAL.—Not later than 1 year after 16
469+the date of enactment of this Act, and each year 17
470+thereafter, the Director shall publish on a public-fac-18
471+ing website and submit to the relevant committees a 19
472+report that, with respect to categories of positions in 20
473+the competitive service for which an examining agen-21
474+cy examined applicants during the applicable period, 22
475+includes— 23
476+(A) the type of examination used; and 24 18
477+†S 59 ES
478+(B) summary data from examinations that 1
479+are closed, audited, and anonymous on the use 2
480+of examinations for the competitive service, in-3
481+cluding technical assessments. 4

483+EMOGRAPHIC INDICATORS .—In carrying 5
484+out paragraph (1), the Director shall break the data 6
485+down by applicant demographic indicators to facili-7
486+tate direct comparability and trendline comparisons 8
487+to data available as of October 1, 2020, as a base-9
488+line. 10

490+IMITATIONS.—In carrying out this sub-11
491+section, the Director may only publish and submit to 12
492+the relevant committees data relating to examina-13
493+tions for which— 14
494+(A) the related announcement is closed; 15
495+(B) certificates have been audited; and 16
496+(C) all hiring processes are completed. 17

498+ELAYED REPORTING .—If the Director is 18
499+unable to publish and submit the report within the 19
500+timeline required under paragraph (1), the Director 20
501+shall publish on a public-facing website, and submit 21
502+to the relevant committees, a notification of the 22
503+delay that— 23
504+(A) provides a reason for the delay; and 24 19

506+(B) advises the public and the relevant 1
507+committees of the anticipated date of publica-2
508+tion and submission of the report. 3

510+ROVISION OFDATA BYAGENCIES.— 4
511+(1) I
512+N GENERAL.—Not later than 180 days 5
513+after the date of enactment of this Act, the Director 6
514+shall issue guidance to examining agencies regarding 7
515+the data that the Director needs from the examining 8
516+agencies in order to comply with subsections (a) and 9
517+(b). 10

519+EPORTING TIMELINES .—Each examining 11
520+agency shall provide the data outlined in the guid-12
521+ance issued by the Director under paragraph (1) on 13
522+a quarterly basis. 14
523+SEC. 6. GAO REPORT. 15
524+Not later than 3 years after the date of enactment 16
525+of this Act, the Comptroller General of the United States 17
526+shall submit to Congress a report that— 18
527+(1) assesses the implementation of this Act and 19
528+the amendments made by this Act; 20
529+(2) assesses the impact of modifications made 21
530+by this Act to the hiring process for the competitive 22
531+service under section 3304 of title 5, United States 23
532+Code; and 24 20

534+(3) makes recommendations for the improve-1
535+ment of the hiring process for the competitive serv-2
536+ice. 3
537+SEC. 7. EVALUATION FOR POTENTIAL UPDATES OR REVI-4
538+SIONS TO GOVERNMENT-WIDE SYSTEMS OF 5
539+RECORDS AT THE OFFICE OF PERSONNEL 6
540+MANAGEMENT. 7
541+(a) I
542+NGENERAL.—Not later than 1 year after the 8
543+date of enactment of this Act, the Director shall evaluate 9
544+whether the Government-wide system of records notices, 10
545+the OPM/GOVT–5 Recruiting, Examining, and Placement 11
546+Records, and the OPM/GOVT–6 Personnel Research and 12
547+Test Validation Records, or any successor materials there-13
548+to, require updating or revision in order to support the 14
549+implementation of this Act and the amendments made by 15
550+this Act. 16
551+(b) I
552+SSUANCE OFUPDATES ORREVISIONS; NOTICE 17
553+TOCONGRESS.—If the Director determines under sub-18
554+section (a) that any updates or revisions are necessary, 19
555+the Director, in accordance with section 552a of title 5, 20 21
556+†S 59 ES
557+United States Code (commonly known as the ‘‘Privacy 1
558+Act’’), shall promptly— 2
559+(1) issue the updates or revisions; and 3
560+(2) notify the relevant committees. 4

188-‘‘(i) the prioritization of—
189-‘‘(I) job classifications; and
190-‘‘(II) resource requirements; and
191-‘‘(ii) a timeline for full implementation of the
192-transition.

227-to the Director and the relevant committees a cer-
228-tification that use of the technical assessment is
229-impracticable, which certification shall include—
230-‘‘(aa) identification of the job series;
231-‘‘(bb) identification of the number of posi-
232-tions that are included in the job series within
233-the agency for which the examining agency
234-is conducting examinations; and
235-‘‘(cc) a description of the rationale for the
236-determination.

238-FFECTIVENESS OF WAIVER .—A waiver under
239-this subparagraph shall be effective for the period—
240-‘‘(I) beginning on the date that is 1 day after
241-the date on which the applicable certification is
242-submitted under clause (i)(II); and
243-‘‘(II) ending on the date that is 3 years after
244-the date on which the applicable certification is
245-submitted under clause (i)(II).

255-ination for a position in the competitive service, an individual
256-who is determined by an examining agency to be a subject
257-matter expert in the subject and job field of the position may—
258-‘‘(A) develop, in partnership with human resources
259-employees of the examining agency, a position-specific
260-assessment that is relevant to the position, based on job
261-analysis, which may include—
262-‘‘(i) a structured interview; S. 59—5
263-‘‘(ii) a work-related exercise;
264-‘‘(iii) a custom or generic procedure used to
265-measure an applicant’s employment or career-related
266-qualifications and interests; or
267-‘‘(iv) another assessment that—
268-‘‘(I) allows for the demonstration of job-related
269-technical skills, abilities, and knowledge; and
270-‘‘(II) is relevant to the position for which the
271-assessment is developed; and
272-‘‘(B) administer the assessment developed under
273-subparagraph (A) to—
274-‘‘(i) determine whether an applicant for the posi-
275-tion has a passing score to be qualified for the position;
276-or
277-‘‘(ii) rank applicants for the position for category
278-rating purposes under section 3319.

280-EASIBILITY STUDY ON SHARING AND CUSTOMIZATION
281-OF ASSESSMENT .—Not later than 1 year after the date of enact-
282-ment of the Chance to Compete Act of 2024, the Director
283-shall—
284-‘‘(A) conduct a feasibility study that examines the prac-
285-ticability, including a cost benefit analysis, of—
286-‘‘(i) the sharing of technical assessments by an
287-examining agency with another examining agency;
288-‘‘(ii) mechanisms for each examining agency to
289-maintain appropriate control over examination mate-
290-rial that is shared by the examining agency as
291-described in clause (i);
292-‘‘(iii) limits on customization of a technical assess-
293-ment that is shared as described in clause (i) and
294-mechanisms to ensure that the resulting technical
295-assessment satisfies the requirements under part 300
296-of title 5, Code of Federal Regulations (or any successor
297-regulation); and
298-‘‘(iv) the development of an online platform on
299-which examining agencies can share and customize
300-technical assessments as described in this subpara-
301-graph; and
302-‘‘(B) submit to the relevant committees a report on
303-the study conducted under subparagraph (A).

305-EDERALAGENCYTALENTTEAMS.—
306-‘‘(1) I
307-N GENERAL.—An agency may establish 1 or more
308-agency talent teams, including at the component level.
309-‘‘(2) D
310-UTIES.—An agency talent team shall provide hiring
311-support to the agency, including by—
312-‘‘(A) improving examinations;
313-‘‘(B) facilitating the writing of job announcements for
314-the competitive service;
315-‘‘(C) sharing high-quality certificates of eligible
316-applicants; and
317-‘‘(D) facilitating hiring for the competitive service using
318-examinations.
319-‘‘(f) O
320-FFICE OFPERSONNELMANAGEMENT TALENTTEAM.—The
321-Director may establish a Federal talent team to support agency
322-talent teams by—
323-‘‘(1) facilitating hiring actions across the Federal Govern-

325-‘‘(2) providing training;
326-‘‘(3) creating tools and guides to facilitate hiring for the
327-competitive service; and
328-‘‘(4) developing technical assessments.

330-ULEMAKING.—The Director shall promulgate such regula-
331-tions as are necessary to implement and interpret this section.’’.
332-SEC. 4. COMPETITIVE SERVICE CANDIDATE HIRING AND REFORM.
333-(a) REVIEW.—
334-(1) I
335-N GENERAL.—The Director shall conduct a review of
336-examinations for hiring for each position in the competitive
337-service that an examining agency has determined requires a
338-minimum educational requirement because the position is of
339-a scientific, technical, or professional nature pursuant to section
340-3308 of title 5, United States Code, to determine whether
341-data, evidence, or other information justifies the need for edu-
342-cational requirements for the position.
343-(2) C
344-ONSULTATION.—In carrying out paragraph (1), the
345-Director shall consult with, at minimum—
346-(A) agencies, as deemed appropriate by the Director;
347-(B) employee representatives;
348-(C) external experts; and
349-(D) relevant stakeholders.
350-(b) R
351-EPORT ONHIRINGPRACTICES.—Not later than 1 year after
352-the date of enactment of this Act, the Director shall submit to
353-the relevant committees recommendations to amend the hiring prac-
354-tices of examining agencies in accordance with the findings of
355-the review conducted under subsection (a)(1).
356-SEC. 5. REPORTS.
357-(a) IMPLEMENTATION REPORTS.—
358-(1) I
359-N GENERAL.—Not later than 1 year after the date
360-of enactment of this Act, and each year thereafter ending
361-with the fifth publication and submission of the report, the
362-Director shall publish on a public-facing website, and submit
363-to the relevant committees, a report that—
364-(A) examines the progress of examining agencies in
365-implementing the requirements of this Act and the amend-
366-ments made by this Act; and
367-(B) identifies any significant difficulties encountered
368-in the implementation described in subparagraph (A).
369-(2) I
370-NCLUSION IN ANNUAL REPORT .—The Director may
371-include the report required under paragraph (1) as an
372-addendum to the report required under subsection (b).
373-(3) D
374-ELAYED REPORTING .—If the Director is unable to pub-
375-lish and submit the report within the timeline required under
376-paragraph (1), the Director shall publish on a public-facing
377-website, and submit to the relevant committees, a notification
378-of the delay that—
379-(A) provides a reason for the delay; and
380-(B) advises the public and the relevant committees
381-of the anticipated date of publication and submission of
382-the report.
383-(b) A
384-NNUALREPORT.—
385-(1) I
386-N GENERAL.—Not later than 1 year after the date
387-of enactment of this Act, and each year thereafter, the Director
388-shall publish on a public-facing website and submit to the
389-relevant committees a report that, with respect to categories S. 59—7
390-of positions in the competitive service for which an examining
391-agency examined applicants during the applicable period,
392-includes—
393-(A) the type of examination used; and
394-(B) summary data from examinations that are closed,
395-audited, and anonymous on the use of examinations for
396-the competitive service, including technical assessments.
397-(2) D
398-EMOGRAPHIC INDICATORS .—In carrying out paragraph
399-(1), the Director shall break the data down by applicant demo-
400-graphic indicators to facilitate direct comparability and
401-trendline comparisons to data available as of October 1, 2020,
402-as a baseline.
403-(3) L
404-IMITATIONS.—In carrying out this subsection, the
405-Director may only publish and submit to the relevant commit-
406-tees data relating to examinations for which—
407-(A) the related announcement is closed;
408-(B) certificates have been audited; and
409-(C) all hiring processes are completed.
410-(4) D
411-ELAYED REPORTING .—If the Director is unable to pub-
412-lish and submit the report within the timeline required under
413-paragraph (1), the Director shall publish on a public-facing
414-website, and submit to the relevant committees, a notification
415-of the delay that—
416-(A) provides a reason for the delay; and
417-(B) advises the public and the relevant committees
418-of the anticipated date of publication and submission of
419-the report.

421-ROVISION OFDATA BYAGENCIES.—
422-(1) I
423-N GENERAL.—Not later than 180 days after the date
424-of enactment of this Act, the Director shall issue guidance
425-to examining agencies regarding the data that the Director
426-needs from the examining agencies in order to comply with
427-subsections (a) and (b).
428-(2) R
429-EPORTING TIMELINES .—Each examining agency shall
430-provide the data outlined in the guidance issued by the Director
431-under paragraph (1) on a quarterly basis.
432-SEC. 6. GAO REPORT.
433-Not later than 3 years after the date of enactment of this
434-Act, the Comptroller General of the United States shall submit
435-to Congress a report that—
436-(1) assesses the implementation of this Act and the amend-
437-ments made by this Act;
438-(2) assesses the impact of modifications made by this Act
439-to the hiring process for the competitive service under section
440-3304 of title 5, United States Code; and
441-(3) makes recommendations for the improvement of the
442-hiring process for the competitive service. S. 59—8
443-SEC. 7. EVALUATION FOR POTENTIAL UPDATES OR REVISIONS TO
444-GOVERNMENT-WIDE SYSTEMS OF RECORDS AT THE OFFICE
445-OF PERSONNEL MANAGEMENT.
446-(a) INGENERAL.—Not later than 1 year after the date of enact-
447-ment of this Act, the Director shall evaluate whether the Govern-
448-ment-wide system of records notices, the OPM/GOVT–5 Recruiting,
449-Examining, and Placement Records, and the OPM/GOVT–6 Per-
450-sonnel Research and Test Validation Records, or any successor
451-materials thereto, require updating or revision in order to support
452-the implementation of this Act and the amendments made by this
453-Act.
454-(b) I
455-SSUANCE OF UPDATES OR REVISIONS; NOTICE TOCON-
456-GRESS.—If the Director determines under subsection (a) that any
457-updates or revisions are necessary, the Director, in accordance
458-with section 552a of title 5, United States Code (commonly known
459-as the ‘‘Privacy Act’’), shall promptly—
460-(1) issue the updates or revisions; and
461-(2) notify the relevant committees.
