To provide back pay to reinstated employees of the
Department of Veterans Affairs, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
‘‘This Act may be cited as the Reinstating Employee 4
Salaries To Original Rates and Entitlements Act’’ or the 5
‘‘RESTORE Act’’. 6
SEC. 2. BACK PAY FOR REINSTATED EMPLOYEES OF THE 7
DEPARTMENT OF VETERANS AFFAIRS. 8
(a) B
ACKPAY.—Any individual who was an employee 9
of the Department of Veterans Affairs (including employ-10

ees who were serving under a probationary or trial period 1
due to a promotion) and who was involuntarily removed 2
and subsequently reinstated or appointed to a position at 3
the Department during the period beginning on January 4
20, 2025, and ending on the date of the enactment of this 5
Act shall be entitled to back pay in accordance with sec-6
tion 5596 of title 5, United States Code. 7
(b) L
IMITATION.—Subsection (a) shall not apply to 8
any individual removed from a political position. 9
(c) P
OLITICALPOSITIONDEFINED.—In this section, 10
the term ‘‘political position’’ means— 11
(1) a position described under sections 5312 12
through 5316 of title 5, United States Code (relat-13
ing to the Executive Schedule); 14
(2) a noncareer appointee (as that term is de-15
fined in section 3132(a) of such title); or 16
(3) a position in the executive branch of the 17
Government of a confidential or policy-determining 18
character under schedule C of subpart C of part 213 19
of title 5, Code of Federal Regulations. 20
