A BILL 
To amend the Immigration and Nationality Act to modify 
the eligibility requirements for asylum. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Refugees Using Legal 4
Entry Safely Act’’ or ‘‘RULES Act’’. 5
SEC. 2. MODIFICATION OF ASYLUM ELIGIBILITY. 6
Section 208(a) of the Immigration and Nationality 7
Act (8 U.S.C. 1158(a)) is amended— 8
(1) by amending paragraph (1) to read as fol-9
lows: 10

‘‘(1) APPLICATION AT PORTS OF ENTRY .— 1
‘‘(A) I
N GENERAL.—Any alien who arrives 2
at a port of entry of the United States, irre-3
spective of such alien’s status, may, only at 4
such a port of entry, apply for asylum in ac-5
cordance with this section or, as applicable, sec-6
tion 235(b). 7
‘‘(B) P
ROHIBITION ON PAROLE OR RE -8
LEASE INTO THE UNITED STATES .—Notwith-9
standing section 236(a)(2), an alien applying 10
for asylum at a port of entry may not be pa-11
roled or released into the United States.’’; 12
(2) in paragraph (2)— 13
(A) by striking subparagraph (B); 14
(B) in subparagraph (C), by striking ‘‘Sub-15
ject to subparagraph (D), paragraph’’ and in-16
serting ‘‘Paragraph’’; 17
(C) by striking subparagraph (D); 18
(D) in subparagraph (E), by striking 19
‘‘Subparagraphs (A) and (B)’’ and inserting 20
‘‘Subparagraph (A)’’; 21
(E) by redesignating subparagraphs (C) 22
and (E) as subparagraphs (B) and (C), respec-23
tively; and 24
(F) by adding at the end the following: 25

‘‘(D) EFFECT OF APPREHENSION IN THE 1
UNITED STATES.—Paragraph (1) shall not 2
apply to any alien who is apprehended by or re-3
ferred to the Secretary of Homeland Security as 4
an alien who has entered the United States 5
without inspection and admission or who has 6
remained in the United States beyond the 7
alien’s period of authorized stay.’’; and 8
(3) by striking ‘‘Attorney General’’ each place 9
it appears and inserting ‘‘Attorney General or the 10
Secretary of Homeland Security, as applicable,’’. 11
