15+It is hereby enacted by the General Assembly of the State of Vermont: 10
16+Sec. 1. INTENT 11
17+The intent of this act is for the Agency of Digital Services to provide the 12
18+General Assembly and the public with more transparency about the scope, 13
19+budget, and overall status of certain information technology projects being 14
20+managed by the Agency. This act requires the Agency to include more details 15
21+about information technology projects it manages in its annual reporting as 16
22+well as on its publicly available website in the form of a current projects 17

45-budgetrequestrequiredunder32V.S.A.§306,anannualreportfor
46-informationtechnologyandcybersecurity.Thereportshallreflectthe
47-prioritiesoftheAgencyandshallinclude:
48-(1)performancemetricsandtrends,includingbaselineandannual
49-measurements,foreachdivisionoftheAgency;

29+§ 3303. REPORTING, RECORDS, AND REVIEW REQUIREMENTS 2
30+(a) Annual report and budget. The Secretary shall submit to the General 3
31+Assembly House Committee on Energy and Digital Infrastructure and the 4
32+Senate Committee on Institutions, concurrent with the Governor’s annual 5
33+budget request required under 32 V.S.A. § 306, an annual report for 6
34+information technology and cybersecurity. The report shall reflect the 7
35+priorities of the Agency and shall include: 8
36+(1) performance metrics and trends, including baseline and annual 9
37+measurements, for each division of the Agency; 10
38+(2) a financial report of revenues and expenditures to date for the current 11
39+fiscal year; 12
40+(3) costs avoided or saved as a result of technology optimization for the 13
41+previous fiscal year; 14
42+(4) an outline summary of information, including scope, schedule, 15
43+budget, and status for information technology projects with total costs of 16
44+$500,000.00 or greater a summary of each active information technology 17
45+project managed by the Agency’s Enterprise Project Management Office, 18
46+including each project’s: 19
47+(A) scope; 20

61+this section, including any uses of the waiver authority by the Chief 9
62+Information Officer pursuant to subdivision (d)(3) of this section; 10
63+(7) the Agency budget submission; 11
64+(8) an annual update to the inventory required by section 3305 of this 12
65+title; and. 13
66+(9) a report on the expenditures of the Technology Modernization 14
67+Special Fund, a list of projects receiving funding from the Fund in the prior 15
68+fiscal year, and a list of prioritized recommendations for projects to be funded 16
69+from the Fund in the next fiscal year. 17
70+(b) Records. The Agency shall maintain the following records for 18
71+information technology projects with a total cost of $500,000.00 or greater 19

78+provided by the State government business partner, life-cycle costs, and 2
79+sources of funds for design, development, and implementation, as well as 3
80+maintenance and operations. The business case shall include expected 4
81+benefits, including cost savings and service delivery improvements. 5

83+(d) Independent expert review. 7
84+(1) The Agency shall obtain independent expert review of any new 8
85+information technology projects with a total cost of $1,000,000.00 or greater or 9
86+when required by the Chief Information Officer. 10
87+(2) The independent review shall include: 11
88+(A) an acquisition cost assessment; 12
89+(B) a technology architecture and standards review; 13
90+(C) an implementation plan assessment; 14
91+(D) a cost analysis and a model for benefit analysis; 15
92+(E) an analysis of alternatives; 16
93+(F) an impact analysis on net operating costs for the agency carrying 17
94+out the activity; and 18
95+(G) a security assessment. 19
96+(3) The requirement to obtain independent expert review described in 20

102+Officer if, in his or her the Chief Information Officer’s judgment, such a 1
103+review would be duplicative of one or more reviews that have been, or will be, 2
104+conducted under a separate federal or State requirement. If waived, such 3
105+waiver shall be in writing and in accordance with procedures established by the 4
106+Chief Information Officer. 5
107+(e) Current projects inventory. The Agency shall maintain a project 6
108+inventory on its publicly accessible website that displays the status of all 7
109+current information technology projects managed by the Agency’s Enterprise 8
110+Project Management Office. The inventory shall be updated at least monthly 9
111+and include the: 10
112+(1) State government business partner for each project; 11
113+(2) name of each project; 12
114+(3) start date of each project; 13
115+(4) estimated date of completion at the start of the implementation phase 14
116+of each project along with an indicator as to whether the project is on time; 15
117+(5) estimated project cost at the start of the implementation phase of 16
118+each project along with an indicator as to whether the project is on budget; 17
119+(6) current estimated date of completion of each project; and 18
120+(7) current estimated cost of each project. 19
121+Sec. 3. EFFECTIVE DATE 20
122+This act shall take effect on July 1, 2025. 21
