AnactrelatingtotheAgencyofDigitalServices
ItisherebyenactedbytheGeneralAssemblyoftheStateofVermont:
Sec.1.INTENT
TheintentofthisactisfortheAgencyofDigitalServicestoprovidethe
GeneralAssemblyandthepublicwithmoretransparencyaboutthescope,
budget,andoverallstatusofcertaininformationtechnologyprojectsbeing
managedbytheAgency.ThisactrequirestheAgencytoincludemoredetails
aboutinformationtechnologyprojectsitmanagesinitsannualreportingas
wellasonitspubliclyavailablewebsiteintheformofacurrentprojects
inventory.

Sec.2.3V.S.A.§ 3303isamendedtoread:
§3303.REPORTING,RECORDS,ANDREVIEWREQUIREMENTS
(a)Annualreportandbudget.TheSecretaryshallsubmittotheGeneral
AssemblyHouseCommitteeonEnergyandDigitalInfrastructureandthe
SenateCommitteeonInstitutions,concurrentwiththeGovernor’sannual
budgetrequestrequiredunder32V.S.A.§306,anannualreportfor
informationtechnologyandcybersecurity.Thereportshallreflectthe
prioritiesoftheAgencyandshallinclude:
(1)performancemetricsandtrends,includingbaselineandannual
measurements,foreachdivisionoftheAgency;
(2)afinancialreportofrevenuesandexpenditurestodateforthe
currentfiscalyear;
(3)costsavoidedorsavedasaresultoftechnologyoptimizationforthe
previousfiscalyear;
(4)anoutlinesummaryofinformation,includingscope,schedule,
budget,andstatusforinformationtechnologyprojectswithtotalcostsof
$500,000.00orgreaterasummaryofeachactiveinformationtechnology
projectmanagedbytheAgency’sEnterpriseProjectManagementOffice,
includingeachproject’s:
(A)scope;
(B)budget;

(C)timeline;and
(D)status,whichincludes:
(i)projectclosuredetails;
(ii)projectchangesovertime;and
(iii)otherindicatorsoftheprojectbeingontimeandonbudget;
(5)anannualupdatetothestrategicplanpreparedpursuantto
subsection(c)ofthissection;
(6)asummaryofindependentreviewsasrequiredbysubsection(d)of
thissection,includinganyusesofthewaiverauthoritybytheChief
InformationOfficerpursuanttosubdivision(d)(3)ofthissection;
(7)theAgencybudgetsubmission;
(8)anannualupdatetotheinventoryrequiredbysection3305ofthis
title;and.
(9)areportontheexpendituresoftheTechnologyModernization
SpecialFund,alistofprojectsreceivingfundingfromtheFundintheprior
fiscalyear,andalistofprioritizedrecommendationsforprojectstobefunded
fromtheFundinthenextfiscalyear.
(b)Records.TheAgencyshallmaintainthefollowingrecordsfor
informationtechnologyprojectswithatotalcostof$500,000.00orgreater
managedbytheAgency’sEnterpriseProjectManagementOffice:

(1)Abusinesscase,includingstaffingcosts,whenavailabletoand
providedbytheStategovernmentbusinesspartner,life-cyclecosts,and
sourcesoffundsfordesign,development,andimplementation,aswellas
maintenanceandoperations.Thebusinesscaseshallincludeexpected
benefits,includingcostsavingsandservicedeliveryimprovements.

(d)Independentexpertreview.
(1)TheAgencyshallobtainindependentexpertreviewofanynew
informationtechnologyprojectswithatotalcostof$1,000,000.00orgreater
orwhenrequiredbytheChiefInformationOfficer.
(2)Theindependentreviewshallinclude:
(A)anacquisitioncostassessment;
(B)atechnologyarchitectureandstandardsreview;
(C)animplementationplanassessment;
(D)acostanalysisandamodelforbenefitanalysis;
(E)ananalysisofalternatives;
(F)animpactanalysisonnetoperatingcostsfortheagencycarrying
outtheactivity;and
(G)asecurityassessment.
(3)Therequirementtoobtainindependentexpertreviewdescribedin
subdivision(1)ofthissubsection(d)maybewaivedbytheChiefInformation

Officerif,inhisorhertheChiefInformationOfficer’sjudgment,sucha
reviewwouldbeduplicativeofoneormorereviewsthathavebeen,orwillbe,
conductedunderaseparatefederalorStaterequirement.Ifwaived,such
waivershallbeinwritingandinaccordancewithproceduresestablishedby
theChiefInformationOfficer.
(e)Currentprojectsinventory.TheAgencyshallmaintainaproject
inventoryonitspubliclyaccessiblewebsitethatdisplaysthestatusofall
currentinformationtechnologyprojectsmanagedbytheAgency’sEnterprise
ProjectManagementOffice.Theinventoryshallbeupdatedatleastmonthly
andincludethe:
(1)Stategovernmentbusinesspartnerforeachproject;
(2)nameofeachproject;
(3)startdateofeachproject;
(4)estimateddateofcompletionatthestartoftheimplementationphase
ofeachprojectalongwithanindicatorastowhethertheprojectisontime;
(5)estimatedprojectcostatthestartoftheimplementationphaseof
eachprojectalongwithanindicatorastowhethertheprojectisonbudget;
(6)currentestimateddateofcompletionofeachproject;and
(7)currentestimatedcostofeachproject.
Sec.3.EFFECTIVEDATE
ThisactshalltakeeffectonJuly1,2025.
