1212 AN ACT to amend 227.139 (4) (b); and to create 227.139 (4) (am) of the statutes;
1313 relating to: creating an exemption to certain requirements for rules
1414 promulgated by the Department of Natural Resources relating to groundwater
1515 protection standards for PFAS.

1717 Current law requires an agency to suspend working on a permanent rule if it
1818 determines that the proposed rule may result in more than $10,000,000 in
1919 implementation and compliance costs over any two-year period. This bill creates an
2020 exemption from this requirement for any proposed Department of Natural Resources
2121 rule that relates to establishing groundwater protection standards for perfluoroalkyl
2222 or polyfluoroalkyl substances (PFAS).
2323 The people of the state of Wisconsin, represented in senate and assembly, do
2424 enact as follows:
2525 SECTION 1. 227.139 (4) (am) of the statutes is created to read:
2626 227.139 (4) (am) This section does not apply to a proposed rule of the
2727 department of natural resources relating to establishment of groundwater

3939 SECTION 2. 227.139 (4) (b) of the statutes is amended to read:
4040 227.139 (4) (b) If the department of natural resources believes that par. (a) or
4141 (am) applies to a proposed rule, the department shall include a statement to that
4242 effect in any economic impact analysis prepared under s. 227.137 for the proposed
4343 rule.
